2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to Lot W, DP 391056, 459 Merrylands Road, Merrylands.

Schedule 1 Additional permitted uses

Insert after clause 16:

17      Use of certain land at 459 Merrylands Road, Merrylands

(1)	This clause applies to land at 459 Merrylands Road, Merrylands, being Lot W, DP 391056, identified as “APU 17” on the Additional Permitted Uses Map.
(2)	Development for the purposes of take away food and drink premises is permitted with development consent if the consent authority is satisfied that the floor space of the premises to be used for those purposes does not exceed 100 square metres.
