Holidays and Other Legislation Amendment Act 2012 Part 1 Preliminary [s 1] The Parliament of Queensland enacts— Part 1 Preliminary 1 Short title This Act may be cited as the Holidays and Other Legislation Amendment Act 2012 . 2 Commencement This Act commences on the later of the following— (a) the day this Act is assented to; (b) 2 October 2012. Part 2 Amendment of Holidays Act 1983 3 Act amended This part amends the Holidays Act 1983. 4 Amendment of s 3A (References to public holidays in industrial instruments under IndustrialRelationsAct1999 ) Section 3A(b), ‘to a public holiday for the Birthday of the Sovereign’— omit, insert — ‘to Labour Day, or to a public holiday for the Birthday of the Sovereign or Labour Day,’. Holidays and Other Legislation Amendment Act 2012 Part 3 Amendment of Industrial Relations Act 1999 [s 5] 5 Amendment of schedule (Public holidays) (1) Schedule, entry for 1 May (Labour Day)— omit . (2) Schedule, entry for Birthday of the Sovereign, ‘first Monday in October’— omit , insert — ‘second Monday in June’. (3) Schedule, after entry for Birthday of the Sovereign— insert — ‘ Labour Day A public holiday is to be observed on the first Monday in October.’. Part 3 Amendment of Industrial Relations Act 1999 6 Act amended This part amends the Industrial Relations Act 1999. 7 Amendment of sch 5 (Dictionary) Schedule 5, definition public holiday , paragraph (a), seventh and eighth dot points— omit , insert — ‘• Birthday of the Sovereign (the second Monday in June) • Labour Day (the first Monday in October)’. 2012 Act No. 28 Page 5

Holidays and Other Legislation Amendment Act 2012 Part 4 Amendment of Oaths Act 1867 [s 8] Part 4 Amendment of Oaths Act 1867 8 Act amended This part amends the Oaths Act 1867 . 9 Amendment of s 3 (Oaths for justices of the peace and others) (1) Section 3(2), ‘and wardens appointed under the MineralResources Act 1989 ’— omit , insert — ‘, wardens appointed under the Mineral Resources Act 1989 and commissioners of the Queensland Industrial Relations Commission appointed after the passing of the Holidays and Other Legislation Amendment Act 2012 ’. (2) Section 3— insert — ‘(3) Commissioners of the Queensland Industrial Relations Commission appointed before the passing of the Holidays and Other Legislation Amendment Act 2012 may take the oath of allegiance and the oath of office mentioned in subsection (1) with the necessary adaptations.’. © State of Queensland 2012 Page 6 2012 Act No. 28
