HISTORY TRUST OF SOUTH AUSTRALIA REGULATIONS, 1983

REGULATIONS UNDER THE HISTORY TRUST OF

SOUTH AUSTRALIA ACT, 1981

1. These regulations may be cited as the History Trust of South Australia Regulations, 1983.

2. The Constitutional Museum Regulations, 1980 made on 31 July 1980 and published in the

Government Gazette of the same day at page 385, as varied, are revoked.

Interpretation

3. In these regulations unless the context or subject matter otherwise requires:

"the Act" means the History Trust of South Australia Act, 1981;

"the Director" means the Director appointed by the History Trust of South Australia;

"the Trust" means the History Trust of South Australia established under the provisions of

the History Trust of South Australia Act, 1981.

Access to premises of the History Trust of South Australia

4. Members of the public may, subject to these regulations, have access to the premises of the Trust at such times and on such days as the Trust may from time to time determine; and no members of the public may enter such portions of the premises that bear a sign "Staff Only".

5. An officer or employee of the Trust may refuse admission to any child under the age of ten years to the premises of the Trust unless such child is under the care of an adult person; and such officer or employee may remove or cause to be removed any such child from the premises.

6. An officer or an employee of the Trust may refuse admission to any person to the premises of the Trust when such person is under the influence of an intoxicating liquor or drug; and such officer or employee may remove or cause to be removed any such person from the premises.

Offences

7. Any person who:

(a)

in any part of the premises of the Trust which is open to the public, except the refreshment room or any other portion which may be determined by resolution of the Trust—

(i)

smokes tobacco or any other substance;

(ii)

consumes any food or drink or portion thereof or deposits any bottle, paper, wrapping, carton or any other litter;

and

(b)

in any part of the premises of the Trust except such part as may be determined by resolution of the Trust consumes any alcoholic liquor;

may be removed by an officer or employee of the Trust from the premises of the Trust.

8. Any person who enters upon any part of the premises of the Trust:

(a)

except with the authority of the Trust or the director or any officer or employee of the Trust touches or interferes with any equipment or exhibit or interferes with any case containing any such equipment or exhibit;

(b)

wilfully obstructs any officer or employee of the Trust in the execution of his duty;

(c)

disturbs, annoys or obstructs any other person in the proper use of the premises of the Trust;

(d)

except with the authority of the Trust or the director or any officer or employee of the Trust causes or allows any dog or other animal belonging to him or under his control to enter or remain therein;

(e)

in possession of a fire-arm, knife or any other offensive weapon;

(f)

not being an officer or employee of the Trust or a person authorized by the Act or any regulations made thereunder or by the Trust offers anything for sale;

(g)

is guilty of any offensive or disorderly conduct;

(h)

who without the authority of the Trust or the Director distributes any pamphlet or any other printed or written matter;

may be removed by an officer or employee of the Trust from the premises of the Trust.

9. Any person not being an officer or employee of the Trust or person authorized by the Act or any regulations made thereunder—

(a)

who enters or remains in any part of the premises of the Trust not set apart for the use of the public; or

(b)

who upon being requested to leave the premises by an officer or employee of the Trust continues to remain in any part of the premises of the Trust after closing time of the premises;

shall be guilty of an offence and may be removed by an officer or employee of the Trust from the

premises of the Trust.

Copying, Photographing or Reproducing Exhibits

10. (a) No person shall copy, photograph or reproduce or make any recording or videotape of any kind of any exhibit or chattel in the premises of the Trust or belonging to the Trust or under the care or control of the Trust without having first obtained written permission from the Trust or some person authorized in that behalf whether generally or specially by the Trust.

(b) Any person committing a breach of this regulation may be removed from the premises of the History Trust of South Australia.

General Penalty

11. Any person who is in breach of or fails to comply with any provision of these regulations shall be guilty of an offence and liable to a penalty not exceeding $500.
