I, PHILIP MICHAEL JEFFERY, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the HIH Royal Commission (Transfer of Records) Act 2003.

Name of Regulations
These Regulations are the HIH Royal Commission (Transfer of Records) Regulations 2005.
Commencement
These Regulations commence on
11 February 2005 .
Definitions
In these Regulations:
Act means the HIH Royal Commission (Transfer of Records) Act 2003.
Department means the Department of the Prime Minister and Cabinet.
Secretary means the Secretary to the Department.
Note Several other words and expressions used in these Regulations have the meaning given by section 3 of the Act. For example:
·ASIC
·HIH Royal Commission
·record.
ASIC’s access to records of the HIH Royal Commission
For section 6 of the Act:
(a)ASIC is to have access to any record of, or relating to, the HIH Royal Commission to which section 6 of the Act applies if the Secretary authorises ASIC, in writing, to have access to the record; and
(b)if the Secretary authorises ASIC, in writing, to have access to an electronic copy or version of a record mentioned in paragraph (a), ASIC is to have access to the electronic copy or version of the record and any associated data.
Note Sections 4 and 5 of the Act provide that ASIC is entitled to the custody of certain records of the HIH Royal Commission, and electronic copies of certain records of the HIH Royal Commission must be provided to ASIC. Section 6 relates to access to other records to which sections 4 and 5 do not apply.
Delegation
The Secretary may, in writing, delegate to an SES employee in the Department all or any of the Secretary’s powers or functions mentioned in regulation 4.
