1. These regulations may be cited as the Highways Act (Goolwa-Hindmarsh Island Ferry)

Regulations, 1982.

2. These regulations shall take effect from 1 August 1982.

3. In these regulations unless the context otherwise requires:

"Act" means the Highways Act, 1926-1982;

"ferry" means the Goolwa-Hindmarsh Island Ferry maintained by the Commissioner pursuant

to the Act;

"permit" means a priority permit issued pursuant to these regulations.

4. An application for a permit must be made on a form in the form of Schedule 1.

5. A permit shall be in the form of Schedule 2.

6. The Commissioner may grant a permit to an applicant who:

(a)

has his principal place of residence on Hindmarsh Island and—

(i)

being over 18 years of age appears on the State Electoral Roll as being resident at that address; or

(ii)

being at least 16 years of age and not having attained the age of 18 years is the registered owner of a motor vehicle; or

(b)

who derives the major part of his income—

(i)

from a business conducted by him on Hindmarsh Island; or

(ii)

from employment the duties of which are solely or predominantly carried out on Hindmarsh Island.

7. Where the holder of a permit uses a permit in accordance with these regulations he shall

be given priority on the ferry over all vehicles except:

(a)

a vehicle being used by the holder of a permit in accordance with these regulations;

(b)

an exempt vehicle within the meaning of section 40 of the Road Traffic Act, 1961;

(c)

a vehicle whose load consists solely or predominantly of perishable goods which are being carried in the course of commerce or trade;

(d)

a school bus.

8. A permit shall be issued subject to the following conditions:

(a)

that it may be used by the holder only when it is affixed to the front windscreen of the motor vehicle in respect of which it was granted and in which the holder of the permit is travelling;

(b)

that the holder complies with all directions given by any person lawfully in charge of the ferry and with all signs and road markings lawfully erected at or near to the ferry for the purpose of controlling or regulating traffic entering or leaving the ferry;

(c)

that it will expire on 30 June of each year;

(d)

that it shall be deemed to have been cancelled if at any time during its currency the holder ceases to have the qualifications as set out in regulation 6 of these regulations;

(e)

that it may be revoked by the Commissioner if he is satisfied that the holder had failed to comply with any of its conditions.

9. (1) Where a permit has:

(a)

been revoked;

(b)

is deemed to have been cancelled; or

(c)

has expired,

the person to whom it had been granted shall forthwith destroy it.

(2) Any person who fails to comply with subregulation (1) of this regulation shall be guilty

of an offence and liable to a penalty not exceeding $40.00.

3. I understand that should my application be successful, a permit may be granted subject to the

following conditions:

(a)

that the permit may be used by me only when it is affixed to the front windscreen of the motor vehicle in respect of which it is issued and in which I am travelling;

(b)

that I will comply with all directions given by any person lawfully in charge of the ferry and with all signs and road markings erected at or near the ferry for the purpose of controlling or regulating traffic entering or leaving the ferry;

(c)

that the permit shall expire on 30 June next;

(d)

that the permit shall be deemed to have been cancelled if at any time during its currency I cease to have the qualifications referred to in paragraph 2;

(e)

that the permit may be revoked by the Commissioner if he is satisfied that I have failed to comply with any of these conditions.
