Making of Guidelines pursuant to section 238-10 of the Higher Education Support Act 2003

I, Julie Bishop, Minister for Education, Science and Training, pursuant to section 238-10 of the Higher Education Support Act 2003 ("the Act"), make the attached amendments to the Commonwealth Grant Scheme Guidelines for the purposes of part 2-2 and subsection 33-25(3) of the Act.

GUIDELINES FOR COMMONWEALTH GRANT SCHEME

AMENDMENT NUMBER 7

(i)   CITATION

These Guidelines may be cited as Amendment Number 7 to the Commonwealth Grant Scheme Guidelines.

(ii)   AUTHORITY

These Guidelines are made under section 238-10 of the Higher Education Support Act 2003.

(iii)                    DATE OF EFFECT

These Guidelines shall come into effect the day after registration on the Federal Register of Legislative Instruments.

PURPOSE

• The purpose of these guidelines is to amend the Commonwealth Grant Scheme Guidelines made on 2 June 2004.

• Delete paragraph 8.5 of Chapter 8 of the Commonwealth Grant Scheme Guidelines and replace the paragraph with the following:

8.5     ADJUSTMENTS TO BASIC GRANT AMOUNT (SECTION 33-20): Table A providers

8.5.1The adjustments set out in section 33-25 of the Act apply only to a Table A provider’s basic grant amount.

2006 Adjustments

8.5.5      Except as provided in paragraphs 8.5.10a and 8.5.10b, the adjustments set out in section 33-25 of the Act do not apply to a provider’s basic grant amount for the 2006 grant year.

8.5.10a  If a provider’s corrected basic amount for 2005 is less than 99% of the provider’s basic grant amount for that year, an adjustment will be calculated using the methodology specified in subsections 33-25(4) and (5) of the Act unless the Minister determines in a particular case that it would be reasonable to make no adjustment.

8.5.10b  A provider’s basic grant amount for 2006 shall be reduced by any adjustment required under paragraph 8.5.10a.

8.6ADJUSTMENTS TO BASIC GRANT AMOUNT (SECTION 33-20): non-Table A providers

8.6.1The adjustments, set out in paragraphs 8.6.5 to 8.6.15 apply only to non-Table A providers that provide Commonwealth supported places in national priority areas.

8.6.5    If the number of Commonwealth supported places that were provided by a provider in the preceding year for each national priority exceeds the number of allocated places in that national priority area, there will be no adjustment to the basic grant amount.

8.6.10  If the number of Commonwealth supported places that were allocated to and provided by a provider in the preceding year for each national priority is fewer than the number of allocated places for that higher education provider in that national priority area, there will be a reduction to the basic grant amount.

8.6.15  The reduction specified in paragraph 8.6.10 above will be an amount equal to the difference between the basic grant amount for the preceding year and the grant amount payable for the number of Commonwealth supported places provided for each agreed national priority in the preceding year.
