COMMONWEALTH GRANT SCHEME GUIDELINES No.1

Amendments to Guidelines made under section 238-10 of the Higher Education Support Act 2003

I, Julia Gillard, Minister for Education pursuant to section 238-10 of the Higher Education Support Act 2003 (‘the Act’), make the attached amendments to the Commonwealth Grant Scheme Guidelines No.1, which provide for matters under Part 2-2 and section 93-10 of the Act.

Commonwealth Grant Scheme Guidelines No.1

Amendment No. 3

(i)     CITATION

These guidelines may be cited as Amendment No. 3 to the Commonwealth Grant Scheme Guidelines No.1.

(ii)     AUTHORITY

These guidelines are made under section 238-10 of the Higher Education Support Act 2003.

(iii)     DATE OF EFFECT

These guidelines will come into effect the day after registration on the Federal Register of Legislative Instruments.

(iv)    AMENDMENT

These Guidelines amend the Commonwealth Grant Scheme Guidelines No. 1 which were registered on 12 December 2006, which commenced on 13 December 2006 (see F2006L04079) and which were amended on 5 September 2007 (see F2007L03523) with from 1 January 2008 (see F2008C00071).  A second amendment was registered on 27 February 2008, and commenced on 28 February 2008 (see F2008C00134). This amendment was disallowed on 14 May 2008, and the guidelines reverted  to the previous amendment.

PURPOSE

• The purpose of this amendment is to remove sections 7.15-7.20 of the Commonwealth Grant Scheme Guidelines No.1, thereby removing the imposition on higher education providers of the Higher Education Workplace Relations Requirements (HEWRRs). This amendment will also remove any references to HEWRRs in the guidelines.

• The Commonwealth Grant Scheme Guidelines No. 1 are amended as follows:

ITEM 1

• Replace paragraph 7.1.1 with the following new paragraph 7.1.1:

7.1.1  With reference to paragraph 33-17(1)(a) of the Act, the purpose of this chapter is to impose on higher education providers that receive funding under the Commonwealth Grant Scheme requirements known as the National Governance Protocols, and to specify a date in respect of those requirements (the “Protocols Compliance Date”) for the purposes of paragraph 33-17(1)(c) of the Act.
