HIGH COURT RULES

Statutory Rules 1968, No. 4 (a)

Commencement.

1. These Rules shall take effect on the first day of February, 1968.

Repeal.

2. Order 71, rule 102, is repealed.

Fees.

3. Order 72, rule 8, is amended by adding at the end thereof the following sub-rule:—.

“(2.) The last preceding sub-rule does not require the payment of a fee or charge in respect of a matter specified in the Third Schedule in a case where a note to an item in that Schedule provides that the matter may be done without payment of that fee or charge.”.

Fees required to be paid.

4. Order 72, rule 9, is amended by inserting after the word “document” (first occurring) the words “in respect of which a fee is payable or a charge provided under these Rules”.

Decimal currency.

5. The First Schedule is amended—

(a)by omitting from Forms 2 and 4 the symbol “£” and inserting in its stead the symbol “$”;

(b)by omitting from Form 27 the symbol “£” (first, second and third occurring) and inserting in its stead the symbol “$”;

(c)by omitting from Form 27 the words—

7.—(1.) The Third Schedule is repealed and the Schedule set out in the Second Schedule to this Rule is inserted in its stead.

(a) Made under the Judiciary Act 1903–1966 as of 12 December 1967; notified in the Commonwealth Gazette on 18 January 1968.

(2.) Where, in relation to a proceeding commenced before the date on which these Rules took effect—

(a)a fee was paid before that date in respect of a matter in accordance with an item in the Schedule repealed by the last preceding subparagraph; and

(b)the note to the item in the Schedule inserted by that sub-paragraph that applies to that matter provides that an additional fee under item 29, 30 or 31, whichever is applicable, of that Schedule is not payable in respect of any other matter, being a matter for which a separate fee would have been payable under the Schedule so repealed,

that separate fee continues to be applicable to that other matter in relation to that proceeding.

(3.) Where an action, appeal, special case, written case, order nisi or application for an order absolute was entered for hearing before the date on which these Rules took effect, the fee specified in item 8 in the Third Schedule to the High Court Rules is payable for each copy of the reasons for judgment given in the proceeding that is issued after that date to a person, whether or not the person is a party to the proceeding.

Witnesses attending in more than one action or matter will be entitled to a proportionate part only of their expenses in each action or matter.

A witness shall be deemed to be a country witness if he does not reside within twenty-five miles of the court house where the cause or matter is tried or heard.

In addition to the above allowances, country witnesses may be allowed such sum as the taxing officer thinks reasonable to provide for actual expenses of conveyance to and from the place of trial or hearing and a reasonable amount for maintenance or sustenance.

The taxing officer may also allow such amount as he thinks reasonably and properly incurred and paid to witnesses for qualifying to give skilled evidence.

Notwithstanding anything in the scale, the taxing officer may allow to an expert witness a special fee for any attendance at Court not covered by the foregoing paragraphs of this item when the witness is acting as an expert in assisting counsel or a solicitor for a period during the trial or hearing. The scale in this item does not affect the existing practice of allowing qualifying fees to witnesses.

Disbursements.

99. All court fees, counsel’s fees and other fees and payments to the extent to which they have been properly and reasonably incurred and paid shall be allowed.

The remuneration allowed to a solicitor shall be governed by the foregoing scale but in special cases the taxing officer may in his discretion allow such additional charges or disbursements as he considers reasonable.

In the abovementioned scale of costs the words ‘the solicitor’ shall mean the solicitor on the record, his partner or his agent or his agent’s partner.”.
