Rule of Court Amending the High Court Rules2

(As of Friday the 18th day of June 1982)

PURSUANT to the Judiciary Act 1903 as amended and to all other powers thereunto enabling, it is ordered that the High Court Rules, being Statutory Rules 1952, No. 23, as amended, be further amended as follows:—

  • 1.

    Order 39 rule 7 (1) is repealed and replaced by the following sub-rule:

    • “(1)

      An affidavit may be sworn before a Justice, a Registrar, a person having authority to administer an oath and to take and receive affidavits for the purposes of the Federal Court of Australia, or the Supreme Court of a State or Territory, or a Justice of the Peace, whose name, title and the date when and the place where the affidavit was sworn shall be stated in the jurat.”

  • 2.

    Order 39 rule 19 is repealed.

  • 3.

    Order 39 rule 20 is repealed.
