High Court Rules (Amendment)

WE, Justices of the High Court of Australia, make the following Rules of Court under the Judiciary Act 1903.

Commencement

1.    These Rules commence on 3 April 1995.

Amendment

2.   The High Court Rules are amended as set out in these Rules.

3.   Order 69A, rule 3 (Time for filing and documents to be filed)

3.1   Add at the end:

“(3)

The concise statement referred to in paragraph (1) (f) shall be in the form numbered 62 in the First Schedule.”.

4.   Order 69A, rule 5 (Appearance)

4.1   Subrule 5 (2):

Omit “62”, substitute “63”.

5.   Order 69A, rule 8 (Summary of argument)

5.1   Subrule 8 (2):

After:

• “Part IV:

  reasons why leave or special leave should be granted;”;

insert:

 “Part IVa: any reasons why an order for costs should not be made in favour of the respondent in the event that the application is refused;”.

6.   Order 69A, rule 10 (Discontinuance of application)

6.1   Subrule 10 (1):

Omit “63”, substitute “64”.

7.   Order 70, rule 2 (Institution of appeals)

7.1   Paragraph 2 (2) (c):

After “which”, insert “leave or”.

7.2   Paragraph 2 (2) (d):

After “when”, insert “leave or”.

8.   Order 70, rule 3 (Time for filing)

8.1   Subrule 3 (1):

After “of”, insert “leave or”.

9.   Order 70, rule 12 (Preparation and filing of appeal books)

9.1   Paragraph 12 (11) (i):

After “granting”, insert “leave or”.
