These two matters, which were heard together, are

cases stated to the Full Court of this Court by a judge of this

Court in proceedings before him in matters G. No. 74 and G.

No. 78 of 1977.

The proceedings in G. No. 74 of 1977 were instituted by information wherein it was alleged that Riley McKay Pty. Limited, the defendant, was guilty of an offence in that it had contravened s.53(a) of the Trade Practices Act 1974 ("the

Actn).

The proceedings in G. No. 78 of 1977 were between

the same parties and i-l;

was alleged ir? tne information that

the defendant had contravened s.53(c) of the Act.

Both

proceedings

a r e c l e a r l y cr iminal proceedings.

It was held by a majori ty of a F u l l Court of t h i s Court

i n judgments del ivered on 21 May 1979 i n matters of

Henaerson v. Pioneer Homes Pty. Limited and Henderson v.

Pioneer Agencies Pty. Llmited t h a t a judge of t h i s Court i n

proceedings a l l eg ing contraventions of

s .53(e)

and

( g )

of

t h e Act had no power

t o s t a t e a case f o r t h e considerat ion

of a F u l l Court of th is Court.

I n my

opinion t h e same

considera t ions apply t o t h e two

matters before t h i s Cour-l;
