HERITAGE ACT 1977—REGULATION

(Relating to fees)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Heritage Act 1977, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1st July, 1992.

Amendment of the Heritage Regulation I978

2. The Heritage Regulation 1978 is mended:

(a)

by omitting clause 3 and by inserting instead the following clause: Applications for approval

3. (1) In this clause:

“activity” means the doing of anything referred to in section

57 (1) (a), (b), (c), (d), (e), (f) or (g) of the Act;

“costs” in relation to an activity, means the estimated cost of

carrying out that activity

(2) For the purposes of section 60 of the Act, the prescribed fee for an application for approval of an activity the cost of which:

(a) is $50,000 or less—is $40; or
(b) is $50,000 or more but less than ,$100,000—is $75; or

(c) is $100,000 or more but less than $500,000—is $120; or

(d) is $500,000 or more but less than $1,000,000—is $170; or

(e) is $1,000,000 or more—is $300.

(b)

by omitting from clause 4 (b) the matter “$5” and by inserting instead the matter “$10”;

(c)

by omitting from clause 5 the matter “$5” and by inserting instead the matter “$10”;

(d)

by inserting in Form 1 at the end of the matter relating to details of the land to which the application relates the following matter: Estimated cost of the activity $ .........................

EXPLANATORY NOTE

The object of this Regulation is to increase fees for applications for approval of the doing of certain activities in respect of buildings, works, relics or places subject to interim conservation orders or pemanent conservation orders and to increase the fees payable for excavation permits and certificates under the Heritage Act 1977.

Fees payable for applications for approval of activities will vary according to the

estimated cost of the activity concerned.
