HERCOLE PIETRO GENOVESE

v

CITY OF PERTH

[2012] HCASL 108
P15/2012

  1. The City of Perth prosecuted the applicant in the Magistrates Court of Western Australia for stopping a vehicle on or over a footpath.  The applicant was convicted and fined $100 with costs of $89.70.

  2. The applicant applied for leave to appeal against his conviction to the Supreme Court of Western Australia.  Jenkins J of that Court refused leave on two of the applicant's grounds.  She granted leave on the other ground, but dismissed the appeal.  The applicant's application for leave to appeal against the orders of Jenkins J to the Court of Appeal of the Supreme Court of Western Australia (McLure P, Buss and Mazza JJA) was refused.

  3. The applicant raises no point of general principle.  An appeal to this Court would not enjoy sufficient prospects of success to warrant a grant of special leave to appeal.

  4. Pursuant to r 41.10.5 of the High Court Rules 2004 we direct the Registrar to draw up, sign and seal an order dismissing the application.
