An Act to Amend "The Heavy Vehicles Act of THE HEAVY 1925" in certain particulars. VEHICLES AM~~ ~ ENT [ASSENTED TO 27TH NOVEMBER, 1929.J ACT OF 1929. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- Short title 1. This Act may be cited as "The Heavy Vehicles ~~ ~struction Act Amendment Act of 1929," and shall be read as one of Act. with *" The Heavy Vehicles Act of 1925," herein referred to as the Principal Act. The Principal Act and this Act may collectively be cited as "The Heavy Vehicles Acts, 1925 to 1929." Amendments of the Principal Act. Amendment of s. 2. 2. Section two of the Principal Act is amended by the insertion, after the definition of "Prescribed," of the following definition, namely:- Regiatrar. "" Registrar"-The officer appointed by the Minister to be Registrar or any person who, in the absence of the Registrar,is appointed by the Minister to act as Registrar during such absence;". In the definition of "This Act" in the said section, before the word "regulations" the words" notifications and" are inserted. Amendment of s. 3. 3. (1.) Section three of the Principal Act is amended as follows:- (a) Paragraph (c) of subsection ope of the said section is repealed and the following paragraph (c) is inserted in lieu thereof:- "(c) Motor trucks which, although ordinarily used for the carriage of goods, are also occasionally let or used for the carriage of more than seven passengers; and". (b) In provision (ii.) of subsection two of the said section, the word "ordinarily" is repealed and the word "solely" is inserted in lieu thereof. * 16 Geo. V No. 22, supra, page 11499.
TRAFE'IC. 1929. Heavy Vehicles Act Amendment Act. The following proviso is also inserted, after the words " carriage of primary produce" in the said provision (ii.), namely:- "Provided that the carriage of any goods other than primary produce and not intended for sale shall not render the vehicle in which such goods are carried liable to registration if it is otherwise solely used for the carriage of primary produce." In the said provision (ii.), in the paragraph commencing with the words "And for the purposes," after the words "this Act" the following proviso is inserted, namely:- " Provided that, except in the case of fruit, vegetables of a highly perishable nature (as may be determined by the Minister from time to time by notification in the Gazette), milk, cream, fresh meat, and live stock, and stone, road metal, gravel, earth, sand, clay, or loam used for the construction or maintenance of any road for the Crown or for any corporation representing the Crown or for any Local Authority or other local self-governing body, the exemption granted by this provision (ii.) shall apply only to vehicles conveying primary produce to the nearest railway station with suitable loading facilities or to the nearest point on Local Authority tramways with suitable loading facilities; ". The word "or" occurring after the words "this Act" is transposed to occur before provision (iii.). (c) In provision (iii.), after the word "tramway" the full stop ( . ) is repealed and a semicolon ( ; ) and the word " or" are inserted in lieu thereof. (d) The following new provision (iv.) is inserted after the said provision :- "(iv.) Any motor truck which, although ordinarily used for the carriage of goods, is also occasionally used for the carriage of more than seven persons for charitable or family purposes and not in any case for hire or reward: Provided that the Registrar may issue a permit for the use of .any motor truck for 12793

V· No. 13,1929. the carriage of more than seven persons if he is satisfied that such motor truck will be used for public purposes or purposes of a like nature and not in any case for hire or reward: Provided further that the use of any such motor truck by any sporting body shaH not be deemed to be a public purpose or a purpose of a like nature." (2.) The following new ~ubsection three is added to the said section, as follows :- Heavy vehicles carrying primary produce on traffic routes. " (3.) Notwithstanding anything hereinbefore con- tained, in the case of a traffic route established and declared under the provisions of paragraph (b) of section four of this Act, the Minister in his discretion may, upon the recommendation of the Local Authority concerned, by notification in the Gazette, direct and declare that provision (ii.) of subsection two aforesaid shall not apply, or shall only partly apply, as may be recommended by the Local Authority concerned and as set forth in such notification: Provided alw.ays that the Minister in his discretion may by any subsequent notification vary any such prior notification. Any notification under this subsection, on publication in the Gazette, shall have the force of law and shall be obeyed by all persons concerned." UPPER BURNETT AND CALLIDE LAND SETTLEMENT.
