Part 1—Preliminary

1—Short title

These regulations may be cited as the Heavy Vehicle National Law (South Australia) (Expiation Fees) Variation Regulations 2020.

2—Commencement

These regulations come into operation on the day on which regulation 8 of the Heavy Vehicle National Law (South Australia)(Amendment of Law) Regulations 2020 comes into operation.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Variation of Schedule 1—Offences, prescribed offences and expiation fees

1. Schedule 1, Part 2, Division 1, entry relating to section 250(1)—after paragraph (b) insert:

(c)     for a severe risk breach $1 121

1. Schedule 1, Part 2, Division 1, entry relating to section 251(1)—after paragraph (b) insert:

(c)     for a severe risk breach $1 121

1. Schedule 1, Part 2, Division 1, entry relating to section 254(1)—after paragraph (b) insert:

(c)     for a severe risk breach $1 121

1. Schedule 1, Part 2, Division 1, entry relating to section 256(1)—after paragraph (b) insert:

(c)     for a severe risk breach $1 121

1. Schedule 1, Part 2, Division 1, entry relating to section 526(4)—delete "defect notice to operator" and substitute:

   vehicle defect notice to operator as soon as practicable within 14 days after notice issued

2. Schedule 1, Part 2, Division 1, entry relating to section 529—delete the entry and substitute:

529	Using or permitting the use of a heavy vehicle in contravention of a vehicle defect notice—
(a)    for a major defect notice or minor defect notice	$674
(b)    for a self-clearing defect notice	$336

1. Schedule 1, Part 2, Division 1, entry relating to section 531A(4)—delete the entry

2. Schedule 1, Part 2, Division 1, entry relating to section 531A(5)—delete the entry
