Heavy Vehicle National Law Application (Infringements) Amendment Regulations 2018

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Heavy Vehicle National Law Application (Infringements) Regulations 2013—

(a)to prescribe certain offences to be infringement offences under the Heavy Vehicle National Law (Victoria); and

(b)to revoke provisions that prescribe certain offences to be infringement offences under the Heavy Vehicle National Law (Victoria).

2Authorising provision

These Regulations are made under section 54 of the Heavy Vehicle National Law Application Act 2013.

3Commencement

These Regulations come into operation on 22 October 2018.

4Principal Regulations

In these Regulations, the Heavy Vehicle National Law Application (Infringements) Regulations 2013[1] are called the Principal Regulations.

5Schedule amended

(1)In Part 1 of the Schedule to the Principal Regulations, items 33, 51, 52, 54, 55, 56, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66, 67, 68, 69, 70, 71, 72, 73, 74, 83, 84, 85, 86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 97, 98, 99, 100, 101, 102 and 103 are revoked.

(2)After item 152 of Part 1 of the Schedule to the Principal Regulations insert—

"152AAn offence against section 319A(2) of the National Law.".

(3)In item 154 of Part 1 of the Schedule to the Principal Regulations, for "321(2)" substitute "321(3)".

(4)After item 156 of Part 1 of the Schedule to the Principal Regulations insert—

"156AAAn offence against section 324(2) of the National Law.".

(5)After item 160 of Part 1 of the Schedule to the Principal Regulations insert—

"160AAAn offence against section 341(5) of the National Law.".

(6)In item 198 of Part 1 of the Schedule to the Principal Regulations, for "568(3)" substitute "568(3)(b)".
