Effluent and Liquid Waste) Amendment

Regulations (No. 5) 2004

Made by the Governor in Executive Council.

1.	Citation These are the Health (Treatment of Sewage and Disposal of Effluent and Liquid Waste) Amendment Regulations (No. 5) 2004.
2.

Commencement Division 58 of the State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 comes into operation or on the day of their publication in the Gazette, whichever is the later.

3.

The regulations amended (Treatment of Sewage and Disposal of Effluent and Liquid Waste) Regulations 1974*.

Regulation 10 amended time” as follows:

(a) in paragraph (a)(ii) by deleting “brought an appeal under section 37 of the Act against the requirement,” and inserting instead —

“

made an application for a review of the

decision under section 36 of the Act,

”;

(b)

by deleting paragraph (c) and the full stop after it and “

(c) in the case where the owner has made an application for a review of the decision under

section 36 of the Act, as soon as practicable
after the State Administrative Tribunal has
made a final decision in relation to the

application.

”.
