Alteration of other rules of organisation.

[1] On 14 March 2018 the Health Services Union (the Union) lodged with the Fair Work Commission a notice and declaration setting out particulars of alterations to its rules. On 11 May 2018 the Union confirmed that it had placed a notice on its website to advise its members that alterations had been lodged.

[2] The particulars set out alterations to Rules 15, 22, 23, 28, 32, 36 and 94.

[3] The alterations clarify and refine the provisions in the rules which regulate elections for office in the Union and its Branches. A number of minor, technical amendments have also been made.

[4] On the information contained in the notice, I am satisfied the alterations have been made under the Union’s rules.

[5] On 11 May 2018, Dan Hill, National Senior Vice President, gave consent, under subsection 159(2) of the Fair Work (Registered Organisations) Act 2009, for the Delegate to amend the alterations for the purpose of correcting a typographical, clerical or formal error.

[6] Accordingly the following correction has been made:

    ● In proposed rule 23 B(d)(viii)(a) the second appearing instance or the word “ballot” has been deleted and the word ‘lot’ inserted in lieu.

[7] In my opinion, the alterations comply with and are not contrary to the Fair Work (Registered Organisations) Act 2009, the Fair Work Act 2009, modern awards and enterprise agreements, and are not otherwise contrary to law. I certify accordingly under subsection 159(1) of the Fair Work (Registered Organisations) Act 2009.
