This regulation may be cited as the Health Services Legislation Amendment Regulation (No. 1) 1995 . ˙ Commencement 2. Sections 9 and 10 commence on 1 January 1996. PART 2—AMENDMENT OF HEALTH SERVICES (PUBLIC HOSPITALS FEES AND CHARGES) REGULATION 1992 ˙ Regulation amended 3. This part amends the Health Services (Public Hospitals Fees and Charges) Regulation 1992. ˙ Insertion of heading 4. Before section 1— insert — ‘ PART 1—PRELIMINARY ’. ˙ Replacement of s 1 (Short title) 5. Section 1— omit, insert — ˙ ‘ Short title ‘ 1. This regulation may be cited as the HealthServicesRegulation1992 .’.

Section 3, definition “third party patient” , paragraph (b)— omit, insert— ‘(b) receives, or establishes a right to receive, for the injury, illness or disease— (i) compensation, or payment in settlement of a claim for compensation, other than compensation under the CriminalCode, chapter 65A; or (ii) damages or payment in settlement of a claim for damages.’. ˙ Insertion of heading 7. Before section 4— insert — ‘ PART 2—PUBLIC HOSPITALS FEES AND CHARGES ’. ˙ Insertion of new pts 3 to 5 8. After section 9— insert — ‘ PART 3—FEES FOR MEDICAL RECORDS ‘ PART 4—DENTAL SERVICES FEES AND CHARGES ‘ PART 5—ADMINISTRATOR’S POWERS ˙ ‘ Administrator’s powers ‘ 12. Without limiting the powers of an administrator of a regional health authority, an administrator may— (a) affix the authority’s common seal to a contract or other

After section 12— insert— ‘ PART 6—TRANSFER OF HEALTH SERVICES ‘ Division 1—Transfer of officers ˙ ‘ Definitions ‘ 13. In this part— “authority” means the Brisbane North Regional Health Authority. “commencing day” means the day this section commences. “transferred officer” means a person mentioned in schedule 2. ˙ ‘ Transfer of officers ‘ 14. Each transferred officer is transferred from the department to the authority. ˙ ‘ Leave and superannuation entitlements ‘ 15.(1) Each transferred officer keeps the leave and superannuation entitlements that accrued to the officer immediately before the commencing day. ‘ (2) The service of a transferred officer is not to be taken as noncontinuous, for the purposes of the officer’s leave or superannuation entitlements, merely because of the transfer effected under this division.

The terms of employment of each transferred officer are those contained in the Regional Health Authorities Employee’s Award—State. ‘ Division 2—Transfer of health services and property ˙ ‘ Sexual health clinic laboratory services ‘ 17.(1) The health service known as the ‘Sexual Health Clinic Laboratory Services, Laboratory of Microbiology and Pathology’, controlled by the department, is transferred to the authority. ‘ (2) The property of the health service listed in schedule 3, part 1 is transferred to the authority. ˙ ‘ Patron care responsible hospitality program ‘ 18.(1) The health service known as the ‘Patron Care Responsible Hospitality Program’, controlled by the authority, is transferred to the control of the department. ‘ (2) The property of the health service listed in schedule 3, part 2 is transferred to the control of the department. ˙ ‘ Cytogenetics services ‘ 19.(1) The health service known as the ‘Cytogenetics Services, Laboratory of Microbiology and Pathology’, controlled by the department, is transferred to the authority. ‘ (2) The property of the health service listed in schedule 3, part 3 is transferred to the authority. ˙ ‘ Neonatal screening services ‘ 20.(1) The health service known as the ‘Neonatal Screening Services, Laboratory of Microbiology and Pathology’, controlled by the department, is transferred to the authority.
