The Parliament of Victoria enacts as follows:
1. Purpose
The purpose of this Act is to change the method of selection and appointment of boards of management of community health centres.
2. Commencement
(1) Section 1 and this section come into operation on
the day on which this Act receives the Royal
Assent.

1997.
3. Substitution of sections 46 to 51

(1) There shall be a board of management of

(1) A member of a board of a community health
centre holds office for the term, not
exceeding 3 years, specified in the
instrument of appointment and is eligible forre-appointment.
(2) The term of office of a member must be
fixed so that, as nearly as possible, one third
of the membership of the board is orbecomes vacant each year.
(3) A person appointed to fill a vacancy on a
board which arises otherwise than by expiry

of a member's term of office holds office for
the remainder of that member's term.
48. Resignation and removal
(1) A member of a board of a community health
centre may resign by writing delivered to the
Governor in Council.
(2) The Governor in Council, on the
recommendation of the Minister, may
remove a member of a board from office.
49. Validity of acts or decisions health centre is not invalid by reason only of—
(a)
a defect or irregularity in or in connection with the appointment of a member of the board; or
(b)
a vacancy in the membership of the board.
50. Procedure of the board
(1) A majority of members of the board for the
time being constitutes a quorum of the board.
(2) Subject to this Division, the procedure of a
board of a community health centre is in the
discretion of the board.
51. Transitional centre holding office immediately before the commencement of section 3 of the Health Services (Community Health Centres) Act 1997 ceases to hold office on that commencement.".
