Explanatory note

The object of this Regulation is to amend the Health Records and Information Privacy Regulation 2017 to extend a current exemption from the Health Privacy Principle against including health information about an individual in a health records linkage system. The Regulation extends the exemption that applies to information held about individuals registered for the My Health Record system trial established under Commonwealth legislation to include information about individuals registered for the My Health Record system generally.

This Regulation is made under the Health Records and Information Privacy Act 2002, including section 75
(the general regulation-making power).

This Regulation is the Health Records and Information Privacy Amendment (My

Health Record) Regulation 2018.

2      Commencement

This Regulation commences on 15 November 2018 and is required to be published on the NSW legislation website.

(1) Clause 8 Exemption for My Health Record system

Omit “My Health Record system trial in the” from clause 8 (1).
