Health Promotion (Amendment) Act 1997

An Act to amend the Health Promotion Act 1995

The Legislative Assembly for the Australian Capital Territory enacts as follows:
Short title
1. This Act may be cited as the Health Promotion (Amendment) Act 1997.
Commencement
2. (1) Sections 1, 2, 3 and 6 commence on the day on which this Act is notified in the Gazette.
(2) Sections 4 and 5 commence on 1 July 1997.
Principal Act
3. In this Act, “Principal Act” means the Health Promotion Act 1995.1
Income
4. Section 23 of the Principal Act is amended by omitting paragraph (b) and substituting the following paragraph:
“(b)the amount transferred to the Board annually under subsection 24 (2);”.
Transfers to the Board
5. Section 24 of the Principal Act is amended—
(a)by omitting subsection (2) and substituting the following subsection:
“(2) The Territory shall transfer to the Board in each financial year an amount equal to the sum of the following amounts:
(a)5% of the amount of tobacco franchise fees paid to the Territory in the calendar year ending on 31 December in the previous financial year;
(b)any additional amount determined by the Minister by instrument.”; and
(b)by omitting from subsection (3) “or (2)” and substituting “or paragraph (2) (b)”.
Repeal
6. Section 28 of the Principal Act is repealed.
