An Ordinance to amend the Health Professions Boards (Elections) Ordinance 1980

Short title

1.  This Ordinance may be cited as the Health Professions Boards (Elections) (Amendment) Ordinance 1986.1

Commencement

2.  This Ordinance shall come into operation on such date as is fixed by the Minister of State for Territories by notice in the Gazette.

Principal Ordinance

3.  In this Ordinance, “Principal Ordinance” means the Health Professions Boards (Elections) Ordinance 1980.2

Interpretation

4.  Section 3 of the Principal Ordinance is amended—

(a)by inserting before paragraph (a) of the definition of “Board” the following paragraph:

“(aa)the Chiropractic Board;”;

(b)by inserting before paragraph (a) of the definition of “Chairman” the following paragraph:

“(aa)in relation to an election held for the purposes of the Chiropractors Ordinance—the Chairman of the Chiropractic Board or, if for any reason the Chairman is unable to act, the Deputy Chairman of the Chiropractic Board;”;

(c)by inserting after the definition of “Chairman” the following definition:

“ ‘Chiropractors Ordinance’ means the Chiropractors Registration Ordinance 1983;”;

(d)by inserting before paragraph (a) of the definition of “election” the following paragraph:

“(aa)the Chiropractors Ordinance;”;

(e)by inserting before paragraph (a) of the definition of “Register” the following paragraph:

“(aa)in relation to an election held for the purposes of the Chiropractors Ordinance—the Register of Chiropractors kept in pursuance of section 11 of that Ordinance;”; and

(f)by inserting before paragraph (a) of the definition of “registered practitioner” the following paragraph:

“(aa)in relation to an election held for the purposes of the Chiropractors Ordinance—a person registered as a chiropractor under that Ordinance;”.

Returning Officer

5.  Section 4 of the Principal Ordinance is amended by omitting “Chief Australian Electoral Officer” and substituting “Electoral Commissioner”.

Nominations

6.  Section 8 of the Principal Ordinance is amended by inserting before paragraph (3) (a) the following paragraph:

“(aa)where the election is an election being held for the purposes of the Chiropractors Ordinance—if that person was, at all times during the period of 3 years immediately preceding the date fixed for the purpose of paragraph 5 (1) (a) in relation to that election, entitled, under the law of a State or Territory, to practise as a chiropractor in that State or Territory;”.

7.  Section 26 of the Principal Ordinance is amended by omitting from sub-sections (2) and (3) “Chief Australian Electoral Officer” (wherever occurring) and substituting “Electoral Commissioner”.

8.  Section 27 of the Principal Ordinance is amended by omitting from sub-sections (2) and (3) “Chief Australian Electoral Officer” (wherever occurring) and substituting “Electoral Commissioner”.

Schedule 1

9.  Schedule 1 to the Principal Ordinance is amended—

(a)by inserting in Forms 1 and 2 “(a) CHIROPRACTIC BOARD” before “(a) DENTAL BOARD”; and

(b)by inserting in Form 3 “(a) Chiropractic Board” before “(a) Dental Board”.

Transitional

10.  In relation to an election held for the purposes of the Chiropractors Registration Ordinance 1983 at any time during the period of 3 years and 6 months commencing on the date of commencement of the Chiropractors Registration Ordinance 1983, paragraph 8 (3) (a) of the Principal Ordinance so amended by this Ordinance has effect as if the words “at all times during the period of 3 years” were omitted from that paragraph.
