(Amendment) Ordinance 1981

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Ordinance under the Seat of Government (Administration) Act 1910.

An Ordinance to amend the Health Professions Boards
(Elections) Ordinance 1980
Short title
| 1. This Ordinance may be cited as the Health Professions Boards | (Elections) |
(Amendment) Ordinance 1981. 1
Principal Ordinance
| Boards (Elections) Ordinance 1980 2 | 2. In this Ordinance, "Principal Ordinance" means the Health Professions |
(a) the candidate who was lowest on the poll at the last count at which they had an unequal number of votes shall be excluded; or (b) if the candidates had an equal number of votes at all preceding counts or if there was no preceding count—the Returning
Officer shall decide by lot which candidate is to be excluded.".
Schedule 2
3. Schedule 2 to the Principal Ordinance is amended—
| (a) | by omitting from paragraph 4 (b) "unelected" and substituting "unexcluded"; and |
(b) by omitting clause 5 and substituting the following clause:
"5 . Where, on any count, 2 or more candidates have the same number
of votes and it is necessary to exclude 1 of them—

4. Schedule 3 to the Principal Ordinance is amended—
(a)
by inserting in paragraph 10 (3) (b) "or if there was no preceding count or transfer" after "preceding counts or transfers"; and
(b)
by inserting in paragraph 11 (b) "or if there was no preceding count or transfer" after "preceding counts or transfers".
