Name of regulation
This regulation is the Health Professionals Amendment Regulation 2007 (No 2).
Commencement
This regulation commences on the day after its notification day.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This regulation amends the Health Professionals Regulation 2004.
Schedule 2, section 2.2 (2) (b)
substitute
(b)has been certified by the Australian Medical Council as having the skills, knowledge and training of a standard suitable to practise medicine; or
Schedule 3, section 3.1, new definition of nurse
insert
nurse means a registered nurse or an enrolled nurse.

3.9Board membership—Act, s 24
(1)The board is made up of the following people (including the president):
(a)4 elected members;
(b)5 appointed members.
(2)The elected members must be—
(a)3 nurses elected by nurses; and
(b)a midwife elected under schedule 4.
(3)The Minister must ensure that the board members appointed include the following people:
(a)a registered nurse;
(b)a midwife;
(c)an enrolled nurse;
(d)2 community representatives who are not entitled to be registered or enrolled.
(4)The president must be—
(a)a registered nurse; or
(b)a midwife; or
(c)an enrolled nurse.
Note The Minister may appoint a person as president only if the person has been registered for a continuous period of at least 3 years immediately before the day of appointment (see s 5 (2)). Register includes enrol (see Act, dict, def register).
(5)In this section:
midwife means an individual who is registered as a midwife under schedule 4.
