s1 4 s4 Health Practitioners Legislation Amendment Act 2005 No. 59, 2005 The Parliament of Queensland enacts— Part 1 Preliminary 1 Short title This Act may be cited as the Health Practitioners Legislation Amendment Act 2005 . 2 Commencement This Act commences on 1 January 2006. Part 2 Amendment of Health Practitioner Registration Boards (Administration) Act 1999 3 Act amended in pt 2 This part amends the Health Practitioner Registration Boards(Administration) Act 1999. 4 Amendment of s 8 (Function of office) Section 8, from ‘to help’— omit, insert— ‘to— (a) help each board to perform its functions; and (b) help the executive officer to perform his or her functions and exercise his or her powers.’.
s5 5 s7 Health Practitioners Legislation Amendment Act 2005 No. 59, 2005 5 Amendment of s 13 (Powers of executive officer) (1) Section 13(3)— renumber as section 13(4). (2) Section 13— insert— ‘(3) The executive officer may exercise a power delegated to the executive officer under the Medical Practitioners RegistrationAct 2001 , section 135. 1 ’. 6 Amendment of s 15 (Delegation by executive officer) Section 15(2)— omit, insert— ‘(2) However, the executive officer may not delegate— (a) the power to enter into a service agreement with a board; or (b) a power delegated to the executive officer under the MedicalPractitionersRegistrationAct2001 , section 135.’. Part 3 Amendment of Medical Practitioners Registration Act 2001 7 Act amended in pt 3 This part amends the Medical Practitioners Registration Act2001. 1 Medical Practitioners Registration Act 2001 , section 135 (Practice in area of need)
s8 6 s8 Health Practitioners Legislation Amendment Act 2005 No. 59, 2005 8 Amendment of s 135 (Practice in area of need) Section 135— insert— ‘(5) The Minister may delegate the Minister’s power under this section to the executive officer. ‘(6) Subsection (5) does not limit any other law under which the Minister may delegate the Minister’s power under this section to a person.’. © State of Queensland 2005
