Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Health Practitioner Regulation National Law (NSW).

Explanatory note
The object of this Regulation is to amend the Health Practitioner Regulation (New South Wales) Regulation 2010 to make provision for transitional matters as a consequence of the former members of State registration authorities for health practitioners being deemed to be members of State registration Boards under the Health Practitioner Regulation National Law (NSW). In particular the Regulation:
| (a) | makes it clear that the expiration of the term of office of such members as members of the previous State registration authority does not affect their membership of the new State registration boards, and |
| (b) | provides that any such person ceases to hold office as a member of the new State registration board on the first appointment by the Minister under that Law of a member to the relevant State registration board. |
This Regulation is made under the Health Practitioner Regulation National Law (NSW), including section 247A (the general-regulation making power) and clause 1 of Schedule 5A to that Law.

1 Name of Regulation
This Regulation is the Health Practitioner Regulation (New South
Wales) Amendment (Savings and Transitional) Regulation 2011.
2 Commencement
This Regulation commences on the day on which it is published on the
NSW legislation website.
3 Amendment of Health Practitioner Regulation (New South Wales) Regulation 2010
Clause 25
Insert after clause 24:
25 Initial members of State Boards
(1) This clause applies to a person who is taken to be a
member of a State Board under section 299 of the Law.(2) The expiration of the person’s term of appointment as a member of a local registration authority does not affect the person’s membership of the State Board. (3) The person ceases to hold office as a member of the State Board on the commencement of the first appointment of a member by the Minister to that Board under section 36 of the Law, unless the person ceased to hold office for any other reason before that appointment. (4) This clause does not prevent the appointment of the person
to a State Board under section 36 of the Law.(5) This clause is taken to have commenced on the commencement of the Health Practitioner Regulation (Adoption of National Law) Act 2009.
