Explanatory note
The object of this Regulation is to amend the Health Practitioner Regulation (New South Wales) Regulation

2010 to prescribe fees relating to:

(a) applications for the approval of premises as suitable for carrying on a pharmacy business by a pharmacist, and
(b) applications for the registration of the holder of a financial interest in a pharmacy business.

This Regulation is made under the Health Practitioner Regulation National Law (NSW), including section 247A (the NSW regulation-making power) of, and clauses 12 (5) and 14 (4) of Schedule 5F to, that Law.

1      Name of Regulation

This Regulation is the Health Practitioner Regulation (New South Wales)
Amendment (Pharmacy Fees) Regulation 2016.

2      Commencement

This Regulation commences on 1 July 2016 and is required to be published on the
NSW legislation website.

3 Amendment of Health Practitioner Regulation (New South Wales) Regulation 2010

Clause 16

Omit the clause. Insert instead:

16      Pharmacy fees

(1) 

For the purposes of clause 12 (5) of Schedule 5F to the Law, a fee specified in the following table is prescribed as the fee for the type of application specified opposite that fee in the table:

Type of application Fee

Application for approval of premises as suitable for carrying on pharmacy business by pharmacist:

(a) initial application $480
(b) annual renewal application:
(i) if lodged on or before due date, or $320
(ii) if lodged after due date $400
Application for registration of holder of financial interest in $550
pharmacy business
(2) For the purposes of clause 14 (4) of Schedule 5F to the Law, the prescribed amount (being the maximum amount that the Council may charge as a fee for inspection of the Register of Pharmacies) is $30.
