Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Health Practitioner Regulation National Law (NSW).

Explanatory note
The object of this Regulation is to clarify that of the 10 members elected or appointed to the Pharmacy Council of New South Wales, only 5 are appointed by the Governor. The remaining 5 are elected to the Council by local pharmacists.

The Regulation also changes a reference to a publication required to be kept in, or accessible by electronic means from, pharmacy premises and professional services room premises. This Regulation is made under the Health Practitioner Regulation National Law (NSW), including section 247A (the general regulation-making power).

1      Name of Regulation

This Regulation is the Health Practitioner Regulation (New South
Wales) Amendment (Pharmacy Council) Regulation 2013.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Health Practitioner Regulation (New South Wales) Regulation 2010

(1) Schedule 1A Membership of relevant Councils

Omit “appointed by the Governor” where firstly occurring in clause 7.

(2) Schedule 3 Equipment and publications required for pharmacy
premises
Omit “Martindale—The Extra Pharmacopoeia” from clause 2.
Insert instead “Therapeutic Guidelines Series (in hardcopy or electronic form)”.
(3) Schedule 4 Publications required for professional services room
premises
Omit “Martindale—The Extra Pharmacopoeia” from paragraph (b).
Insert instead “Therapeutic Guidelines Series (in hardcopy or electronic form)”.
