HEALTH (PESTICIDES) AMENDMENT REGULATIONS (No. 2) 1995.

Made by His Excellency the Governor in Executive Council on the advice of the Pesticides Advisory Committee,

Citation

1. These regulations may be cited as the Health (Pesticides) Amendment

Regulations (No. 2) 1995.

4. Regulation 33 of the principal regulations is amended —

Commencement

2. These regulations come into operation on 1 July 1995.

Principal Regulations

3. In these regulations the Health (Pesticides) Regulations 1956* are

referred to as the principal regulations.

(b) in subregulation (4), by deleting 1100" and substituting the

following —

(c) by inserting after subregulation (4) the following subregulation

(4a) Where, on the initial assessment of an application for registration or for renewal of registration, the Executive Director, Public Health is not satisfied that the applicant meets the requirements of subregulation (3) a fee of $150 is payable for any subsequent assessment which is necessary in order to satisfy the Executive Director, Public Health as required by that subregulation.

Regulation 36 amended

5.   Regulation 36 of the principal regulations is amended —

(a) in subregulation (1), by deleting "$50" and substituting the

following — " $275

(b) by inserting after subregulation (2) the following subregulations —

(2a) Where a fumigator wishes to use a fumigant which is not specified on his licence he may apply to the Executive Director, Public Health for his licence to be endorsed to include that fumigant.

An application for endorsement of a licence shall be in a form approved by the Executive Director, Public Health and shall be accompanied by a fee of $125.

(2b)

Where the Executive Director, Public Health is satisfied that the applicant for endorsement of a licence meets the requirement specified in subregulation (2) (a) he shall endorse the licence accordingly. 17;

(2c)

(c) in subregulation (3), by deleting paragraph (a) and substituting
the following paragraph —

(a)

is valid for a period of one year from the date of issue and, so long as the Executive Director, PublicHealth remains satisfied that the fumigator meets the requirements specified in subregulation (3) (a), (b) and (c), may be renewed annually on payment of a fee of $1.25.

and

(d) by inserting after subregulation (3) the following subregulation

(3a) Where, on an initial assessment of an application for a licence, a renewal of a licence or an endorsement on a licence? the Executive Director, Public Health is not satisfied that the applicant meets the relevant requirements specified in subregulation (2) a fee of

(a) $75 in the case of an application for a
licence; or

(b) $35 in the case of an application for a renewal of a licence or an endorsement on
a licence,

is payable for any subsequent assessment which is necessary in order to satisfy the Executive Director, Public Health that the applicant does meet those requirements.

Regulation 63 amended

6.  Regulation 63 of the principal regulations is amended —

(a) in subregulation (2) (a), by deleting 1250" and substituting the

following —

(c) in subregulation (4), by deleting 1250" and substituting the

Regulation 68 amended

7.   Regulation 68 (c) of the principal regulations is amended —

(a) in subparagraph (i), by deleting "$125" and substituting the

following —

$127.50

(b) in subparagraph (ii), by deleting 162.50" and substituting the

following —

$64 "; and
(c) in subparagraph (iii), by deleting "$125" and substituting the

following —

$127.50

Regulation 70 amended

8.   Regulation 70 (6) (a) of the principal regulations is amended by deleting

"$125" and substituting the following —

" $127.50 ".
