Health (Pest Control Operators) (Amendment)

Regulations 2001

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to amend the Health (Pest Control Operators) Regulations 1992 to—

(a)

make consequential amendments resulting from the Health (Amendment) Act 2001;

(b)

update prescribed qualifications for the licensing of users of pesticides;

(c) update references to Chief General Manager.

2. Authorising provisions

These Regulations are made under sections 108H,

390 and 391 of the Health Act 1958.

3. Principal Regulations

Health (Pest Control Operators) (Amendment) Regulations

In these Regulations the Health (Pest Control
Operators) Regulations 19921 are called the

Principal Regulations.

4. Amendment to objectives

In regulation 2 of the Principal Regulations, paragraph (e) is revoked.

5. Definitions

For regulation 4 of the Principal Regulations substitute—

'4. Definitions

In these Regulations—

"registered education and training

organisation" has the same meaning as
it has in the Victorian Qualifications

Authority Act 2000;

"the Act" means the Health Act 1958.'.

6. Registration fee revoked

Regulation 7 of the Principal Regulations is revoked.

7. Licence fees

For regulation 8 of the Principal Regulations
substitute—

"8. Licence fees

For the purposes of section 108C(2)(a) of the

Act—

(a)

the prescribed fee for a licence (other than a licence granted under section 108C(2A) of the Act) is $435.00;

(b)

the prescribed fee for a licence which is granted under section 108C(2A) of the Act is $145.00.".

8. Qualifications

(1) In regulation 9(1) of the Principal Regulations—

(a) in paragraph (a)—

(i)  after "courses" insert "or the obtaining of a qualification";

(ii)

omit "and to have passed the Pest conducted by the Department";

(b) in paragraph (b)—

(i)  after "courses" insert "or the obtaining of a qualification";

(ii)

omit "and to have passed the Weed conducted by the Department";

(c) in paragraph (c)—

(i)  after "course" insert "or the obtaining of a qualification";

(ii)

omit "and to have passed the Vermin conducted by the Department";

(d) in paragraph (d)—

(i)  after "courses" insert "or the obtaining of a qualification";

(ii)

omit "and to have passed the conducted by the Department".

(2) Regulation 9(2) of the Principal Regulations is

revoked.

9. New regulation 9A inserted

After regulation 9 of the Principal Regulations insert—

"9A. Student training courses

For the purposes of section 108C(2A)(b) of the Act, a prescribed course of training is one of the courses—

(a) set out in Schedule 3; or

(b)

leading to a qualification set out in Schedule 3.".

10. Returns and records

In regulation 10 of the Principal Regulations—

(a) for "Chief General Manager" (wherever occurring) substitute "Secretary";
(b)

in sub-regulation (2), after paragraph (c) "(ca) the area treated and the volume of

chemical used for each job; and";

(c)

in sub-regulations (3) and (4) omit "registered".

11. Medical examinations revoked

Regulation 11 of the Principal Regulations is revoked.

12. Amendments to Schedule 2

(1) In the heading to Schedule 2 to the Principal

Regulations, after "COURSES" insert "AND
QUALIFICATIONS".

(2) In Schedule 2 to the Principal Regulations—

(a)

in Part 1, for the item relating to "Mosquito Identification and Control Training Course" substitute—

"Certificate of Attainment in Units 5, 6 and 18 of training organisation.

Certificate II, National Competency Standards in Pest

Certificate for recognition of current competencies or prior learning in pest control issued by a registered education and training organisation.";

(b) in Part 1, after the item relating to "Western Australia Pesticide Safety, Pest Control Principles, and Pest Control Domestic and Commercial Courses" insert—

"Certificate of Attainment in Units 5, 6, 8, 10 and 18 of Certificate II, National Competency Standards in Pest Management issued by a registered education

and training organisation.";

(c) in Part 2, after the item relating to "Weed Identification and their Control Course" insert—

Management Course of the Diploma of Applied

"Certificate of Attainment in the Pest Plant registered education and training organisation.

Certificate for recognition of current competencies or prior learning in weed control issued by a registered education and training organisation.";

(d) in Part 3, after the item relating to "Pest Animal Management Course" insert—

Management Unit Course of the Diploma of Applied

"Certificate of Attainment in the Pest Animal registered education and training organisation.

Certificate for recognition of current competencies or prior learning in pest animal control issued by a registered education and training organisation.";

(e) in Part 4, after the item relating to "Methyl Bromide Fumigation Course" insert—

"Certificate of Attainment in Unit 6 of Certificate II and Unit 11 of Certificate III National Competency

Health (Pest Control Operators) (Amendment) Regulations

Standards in Pest Management issued by a registered education and training organisation.

Certificate for recognition of current competencies or prior learning in the use of fumigants in pest control issued by a registered education and training organisation.

Phosphine Fumigation Course conducted by The Grain Elevators Board, VicGrain or GrainCorp.".

13. Schedule 3 substituted

For Schedule 3 to the Principal Regulations substitute—

COURSES OF TRAINING

Certificate IV (Advanced Certificate) in Farming conducted
by Victorian Colleges of TAFE and Victorian College of

Agriculture and Horticulture;

Certificate IV (Advanced Certificate) in Horticulture
conducted by Victorian College of Agriculture and
Horticulture and Northern Metropolitan College of TAFE;

Advanced Certificate in Resource Management conducted by Northern Metropolitan College of TAFE;

Certificate V (Associate Diploma) of Applied Science
(Agricultural Services) conducted by Victorian College of

Agriculture and Horticulture;

Certificate V (Associate Diploma) in Sports Turf of TAFE;

Bachelor of Applied Science (Agriculture) conducted by

Victorian College of Agriculture and Horticulture;

Certificate in Recreational Turf Management conducted by

Victorian College of Agriculture and Horticulture;

Certificate in Weed Control conducted by Victorian
Colleges of TAFE;

Health (Pest Control Operators) (Amendment) Regulations

30 hours) conducted by Victorian College of Agriculture

and Horticulture and Victorian Colleges of TAFE;

Graduate Diploma of Applied Science (Horticulture)

A Certificate of Attainment in the Pest Plant Management training organisation;

Unit Course of the Diploma of Applied Science (Natural
Pest Animal Management Course conducted by Victorian
