Health Ombudsman Regulation 2024

1   Short title

This regulation may be cited as the Health Ombudsman Regulation 2024.

2   Commencement

This regulation commences on 2 September 2024.

3   Corresponding interstate interim orders—Act, s 77

For section 77 of the Act, each of the following orders is prescribed to be a corresponding interstate interim order—
(a)an interim prohibition order under the Health Care Complaints Act 1993 (NSW), section 41AA;
(b)an order under the Health and Community Services Complaints Act 2004 (SA), section 56B;
(c)an order under the Health Complaints Act 2016 (Vic), section 90;
(d)an interim prohibition order under the Health and Disability Services (Complaints) Act 1995 (WA), section 52B.

4   Corresponding interstate orders—Act, s 90O

For section 90O of the Act, each of the following orders is prescribed to be a corresponding interstate order—
(a)a prohibition order under the Health Care Complaints Act 1993 (NSW), section 41A;
(b)an order under the Health and Community Services Complaints Act 2004 (SA), section 56C;
(c)an order under the Health Complaints Act 2016 (Vic), section 95;
(d)a prohibition order under the Health and Disability Services (Complaints) Act 1995 (WA), section 52H.

5   Prescribed conduct document—Act, s 288

(1)For section 288(1) of the Act, each of the following documents is prescribed—
(a)the document called ‘National safety and quality health service standards’, published by the Australian Commission on Safety and Quality in Health Care;
(b)the document called ‘Australian charter of healthcare rights’, published by the Australian Commission on Safety and Quality in Health Care;
(c)the document called ‘National code of conduct for health care workers (Queensland)’, published by the department.

2The document mentioned in paragraph (c) is available on the department’s website.
(2)In this section—
Australian Commission on Safety and Quality in Health Care means the commission established under the National Health Reform Act 2011 (Cwlth), section 8.
