Health Ombudsman Regulation 2014

1   Short title

This regulation may be cited as the Health Ombudsman Regulation 2014.

2   Commencement

This regulation commences on 1 July 2014.

3   Corresponding interstate interim orders—Act, s 77

For section 77 of the Act, each of the following is a corresponding interstate interim order—
(a)an interim prohibition order under section 41AA of the Health Care Complaints Act 1993 (NSW);
(b)an order under section 56B of the Health and Community Services Complaints Act 2004 (SA);
(c)an interim prohibition order under the Health Complaints Act 2016 (Vic);
(d)an interim prohibition order under the Health and Disability Services (Complaints) Act 1995 (WA).

4   Corresponding interstate orders—Act, s 90O

For section 90O of the Act, each of the following is a corresponding interstate order—
(a)a prohibition order under section 41A of the Health Care Complaints Act 1993 (NSW);
(b)an order under section 56C of the Health and Community Services Complaints Act 2004 (SA);
(c)a prohibition order under the Health Complaints Act 2016 (Vic);
(d)a prohibition order under the Health and Disability Services (Complaints) Act 1995 (WA).

5   Prescribed conduct document—Act, s 288

For section 288 of the Act, each of the following is a prescribed conduct document—
(a) the National Safety and Quality Health Service Standards, 2nd edition, formulated by the Australian Commission on Safety and Quality in Health Care established under the National Health Reform Act 2011 (Cwlth), section 8;
(b)the ‘Australian charter of healthcare rights’ published by the Australian Commission on Safety and Quality in Health Care;
(c)the ‘National Code of Conduct for health care workers (Queensland)’, dated 1 October 2015 and published by the department.
