s1 3 s6 Health (Nursing Homes) Amendment (No. 1) No. 102, 1996 ˙ Short title 1. This regulation may be cited as the Health (Nursing Homes) Amendment Regulation (No. 1) 1996 . ˙ Regulation amended 2. This regulation amends the Health (Nursing Homes) Regulation 1982 . ˙ Amendment of s 4 (Interpretation) 3. Section 4, heading— omit, insert— Definitions ’. ˙ Omission of s 5 (Forms) 4. Section 5— omit . ˙ Amendment of s 7 (Application for licence to erect or keep nursing home) 5. Section 7, ‘Schedule 4’— omit, insert— ‘schedule 3’. ˙ Amendment of s 10 (Conditions applicable to the issue of a licence) 6. Section 10, ‘A licence’ to ‘The licensee—’— omit, insert— 10.(1) A licence or renewal of licence issued under this regulation must be issued on the conditions mentioned in subsection (2). (2) A licensee—’.
s7 4 s8 Health (Nursing Homes) Amendment (No. 1) No. 102, 1996 ˙ Amendment of s 12 7.(1) Section 12, as a heading— insert— Records ’. (2) Section 12(1)(g)— omit, insert ‘(g) the following registers for each resident— (i) a residents register; (ii) a composite emergency register; (iii) a duplicate emergency register.’. ˙ Insertion of new s 12A 8. After section 12— insert— ˙ Registers 12A.(1) The licensee must record the following information for each resident in the residents register— (a) full name and usual address; (b) sex and age; (c) name and address of next-of-kin; (d) date of admission; (e) name of current medical attendant; (f) nature of the resident’s health; (g) whether the resident has an intensive or ordinary classification; (h) date of the resident’s discharge, transfer or death. (2) The licensee must record the following information for each resident in the composite and duplicate emergency registers— (a) full name;
s9 5 s9 Health (Nursing Homes) Amendment (No. 1) No. 102, 1996 (b) sex; (c) room number; (d) degree of mobility; (e) whether the resident is blind or deaf. (3) The licensee must record the information— (a) for the residents register, within 24 hours after— (i) the resident’s admission; or (ii) the resident’s discharge, transfer or death; and (b) for the composite and duplicate emergency registers—within 1 hour after the resident’s admission. (4) The licensee must record any change in the information— (a) for the residents register—within 24 hours after becoming aware of the new information; and (b) for the composite and duplicate emergency registers—within 1 hour after becoming aware of the new information. (5) The licensee must delete the record of information for a resident from the composite and duplicate emergency registers within 1 hour after the resident’s discharge, transfer or death. (6) The licensee must keep— (a) the residents register with the nursing home’s office records; and (b) the composite and duplicate emergency registers in a place in the nursing home approved by the chief health officer so that the registers are readily available in a fire or other emergency.’. ˙ Replacement of pt 4 hdg (Communicable diseases) 9. Part 4, heading— omit, insert— PART 4—NOTIFIABLE DISEASES ’.

(2) Section 13, ‘communicable disease’— omit, insert— ‘notifiable disease’. (3) Section 13(1), ‘as defined’ to ‘1981’— omit. ˙ Amendment of s 17 (Requirements in respect of the operation of a nursing home) 11. Section 17(b), ‘communicable disease’— omit, insert— ‘infectious disease’. ˙ Amendment of s 23 (Reports regarding electrical installation and fire protection) 12. Section 23(1)(b)(i), ‘Schedule 4 to these Regulations’— omit, insert— ‘schedule 3’. ˙ Amendment of s 25 (Prescribed standards for the keeping of a nursing home) 13. Section 25, ‘Schedule 3 to these Regulations’— omit, insert— ‘schedule 2’.
s 14 7 s 17 Health (Nursing Homes) Amendment (No. 1) No. 102, 1996 ˙ Amendment of s 30 (Penalty) 14. Section 30(1), ‘penalty not exceeding $200.00’ to ‘therefor’— omit, insert— ‘maximum penalty of 4 penalty units’. ˙ Amendment for “inmate” 15.(1) This section amends the following provisions— section 4, definition “extensive care inmate” section 12(1) section 13(3) sections 17, 18, 24 and 28. (2) In the provisions mentioned in subsection (1), ‘inmate’— omit, insert— ‘resident’. ˙ Amendment for “inmates” 16.(1) This section amends the following provisions— sections 10, 12 and 15 section 16(1) part 7, heading section 25. (2) In the provisions mentioned in subsection (1), ‘inmates’— omit, insert— ‘residents’. ˙ Amendment for “inmate’s” 17.(1) This section amends the following provisions— sections 18 and 24.
s 18 8 s 20 Health (Nursing Homes) Amendment (No. 1) No. 102, 1996 (2) In the provisions mentioned in subsection (1), ‘inmate’s’— omit, insert— ‘resident’s’. ˙ Amendment for “Director-General” 18.(1) This section amends the following provisions— section 4, definition “approved” sections 9 and 11 section 12(3) sections 13, 14 and 15 section 16(1) sections 17, 22, 23 and 25 schedule 3. (2) In the provisions mentioned in subsection (1), ‘Director-General’— omit, insert— ‘chief health officer’. ˙ Amendment of sch 3 (Standards) 19. Schedule 3— renumber as schedule 2. ˙ Amendment of sch 4 20.(1) Schedule 4, from ‘Queensland’ to ‘regulation 7’— omit, insert— ‘DOCUMENTS AND PARTICULARS TO ACCOMPANY LICENCE APPLICATIONS section 7’.
