HEALTH (MEAT INSPECTION AND BRANDING)

AMENDMENT REGULATION (NO. 2) 1991

Made by His Excellency the Governor in Executive Council.

Citation

1.   These regulations may be cited as the Health (Meat Inspection and

Branding) Amendment Regulations (No. 2) 1991.

Principal regulations

2. In these regulations the Health (Meat Inspection and Branding)

Regulations 1950* are referred to as the principal regulations.

Regulation IAA amended

3.  Regulation IAA of the principal regulations is amended by inserting

after the definition of "inspector" the following definition —

it "primary producer" means a person who carries on or is engaged in the business of farming or grazing on land that is —
(a) zoned rural under a local authority town planning

scheme; and

(b) used solely or principally for agricultural or grazing
purposes or for a combination of those
purposes;

Regulation lA amended

4.   Regulation lA of the principal regulations is amended —

(a) by deleting "Every" and substituting the following —
”.
" (1) Subject to subregulation (2), every ,

and

(b) by inserting the following subregulation —

(2) Subregulation (1) does not apply in respect of
an animal slaughtered for food by a primary producer

for consumption by the primary producer or his or her

immediate family or employees. 11

Regulation 3 amended

5.   Regulation 3 of the principal regulations is amended —

(a) in subregulation (1) —
(i) by deleting "of the health districts or areas specified in
Schedule B" and substituting the following —
" district "; and

(ii)by deleting "mark or"; and

(b) in subregulation (2) by deleting "of the health districts or areas
specified in Schedule B" and substituting the following —

Regulation 4A amended

6.  Regulation 4A (1) of the principal regulations is amended by deleting

"area or district mentioned in Schedule B" and substituting the following —

7.   Regulation 4B of the principal regulations is amended —

(a) by deleting "unmarked or"; and
(b) by deleting "of the health districts or areas specified in Schedule
B" and substituting the following —

Regulations 4C and 4D inserted

8.   After regulation 4B of the principal regulations the following regulations

are inserted —

Storage of unbranded meat

CC

4C. (1) A person shall not store, or cause or permit to be stored, on any premises unbranded meat unless the keeping of that meat on the premises is authorized by a permit referred to in regulation 4A (2).

(2) It is a defence to a charge of an offence under subregulation (1) for the defendant to prove that on the date of the alleged offence -

(a) he or she was a primary producer; and

(b)

not more than 12 units of unbranded meat were being stored on the premises.

(3) For the purposes of subregulation (2) (b) -

(a)

one unbranded sheep, lamb, calf (under 70 kilograms), goat or deer carcass is the equivalent of one unit of unbranded meat;

(b)

one unbranded pig carcass is the equivalent of 3 units of unbranded meat; and

(c)

one unbranded cow, bull, heifer or steer carcass is the equivalent of 8 units of unbranded meat.

(4) In subregulation (3) "carcass" means a whole carcass or

such portions of a carcass that together would comprise a whole

carcass.

Transportation of unbranded meat

4D. A person shall not transport, or cause or permit to be transported, unbranded meat in a district unless the person is a primary producer who has first obtained a permit in respect of that transportation in the form set out in Schedule E from the local authority of that district.

Regulation 5 amended

9.    Regulation 5 of the principal regulations is amended -

(a) by deleting "unmarked or";
(b) by deleting "Bridgetown - Road Board Hall";

(c)

by inserting in the appropriate alphabetical positions the following items -

13. Schedule C to the principal regulations is amended in Table 2 —
