s1 3 s3 Health Legislation Amendment Regulation (No. 5) No. 222, 2005 2005 Part 1 Preliminary 1 Short title This regulation may be cited as the Health Legislation Amendment Regulation (No. 5) 2005 . Part 2 Amendment of Health (Drugs and Poisons) Regulation 1996 2 Regulation amended in pt 2 This part amends the Health (Drugs and Poisons) Regulation1996. 3 Amendment of s 167 (Midwives) Section 167— insert — ‘(2) Despite subsection (1), to the extent necessary to practise midwifery, a midwife is authorised to— (a) possess a nitrous oxide mixture at any place; or (b) administer a nitrous oxide mixture to a woman as an analgesic during childbirth. ‘(3) In this section— childbirth means the process of labour and delivery beginning with uterine contractions and ending with the expulsion of the placenta and membranes from the woman giving birth. nitrous oxide mixture means a substance containing a mixture of nitrous oxide and oxygen in which the concentration of nitrous oxide is not more than 70%.’.
s4 4 s7 Health Legislation Amendment Regulation (No. 5) No. 222, 2005 2005 Part 3 Amendment of Health Services Regulation 2002 4 Regulation amended in pt 3 This part amends the Health Services Regulation 2002. 5 Amendment of sch 2 (Agreements) Schedule 2, item 6— omit, insert — ‘6 Agreement between Queensland and New South Wales for the funding of admitted and non-admitted patient services provided to residents of New South Wales by Queensland and vice versa, for the period 1 July 2003 to 30 June 2008.’. Part 4 Amendment of Physiotherapists Registration Regulation 2001 6 Regulation amended in pt 4 This part amends the PhysiotherapistsRegistrationRegulation 2001. 7 Amendment of sch 1 (Qualifications for general registration) Schedule 1, after entry for University of Sydney— insert — ‘Master of Physiotherapy University of Sydney’.
s 8 5 s 11 Health Legislation Amendment Regulation (No. 5) No. 222, 2005 2005 Part 5 Amendment of Private Health Facilities Regulation 2000 8 Regulation amended in pt 5 This part amends the Private Health Facilities Regulation 2000. 9 Amendment of sch 2 (Agreements) Schedule 2, item 3— omit, insert — ‘3 Agreement between Queensland and New South Wales for the funding of admitted and non-admitted patient services provided to residents of New South Wales by Queensland and vice versa, for the period 1 July 2003 to 30 June 2008.’ Part 6 Amendment of Radiation Safety Regulation 1999 10 Regulation amended in pt 6 This part amends the Radiation Safety Regulation 1999. 11 Amendment of sch 3A (Authorised persons) Schedule 3A, item 4, after ‘wrist’— insert — ‘or lateral plain film diagnostic radiography projections of the cervical spine’.

Part 7 Amendment of Research Involving Human Embryos and Prohibition of Human Cloning Regulation 2003 13 Regulation amended in pt 7 This part amends the ResearchInvolvingHumanEmbryosand Prohibition of Human Cloning Regulation 2003. 14 Amendment of s 3 (Prescribed guidelines to which NHMRC Licensing Committee must have regard—Act, s 29) Section 3(a)— omit, insert — ‘(a) ‘Ethical Guidelines on the Use of Assisted Reproductive Technology in Clinical Practice and Research’, issued by the NHMRC in 2004;’.
