Part 1 Health Legislation Amendment Regulation (No. 2) 2014 Part 1 Preliminary [s 1] Preliminary 1 Short title This regulation may be cited as the Health Legislation Amendment Regulation (No. 2) 2014 . Part 2 Amendment of Health (Drugs and Poisons) Regulation 1996 2 Regulation amended This part amends the Health(DrugsandPoisons)Regulation 1996. 3 Amendment of s 78 (Specified condition drugs—amphetamine, dexamphetamine, methylamphetamine, methylphenidate, phenmetrazine) (1) Section 78, heading, from ‘methylamphetamine’— omit, insert— lisdexamfetamine, methylamphetamine, methylphenidate (2) Section 78(3), definition specified condition drug , paragraphs (c) to (e)— omit, insert— (c) lisdexamfetamine; (d) methylamphetamine; (e) methylphenidate. 2014 SL No. 81 Page 3
Health Legislation Amendment Regulation (No. 2) 2014 Part 2 Amendment of Health (Drugs and Poisons) Regulation 1996 [s 4] 4 Amendment of s 79 (Prescribing controlled drugs) Section 79(4)(k), from ‘methylamphetamine’ to ‘phenmetrazine’— omit, insert— lisdexamfetamine, methylamphetamine or methylphenidate 5 Amendment of s 82 (Conditions of dispensing) Section 82(2)(h), from ‘methylamphetamine’ to ‘phenmetrazine’— omit, insert— lisdexamfetamine, methylamphetamine or methylphenidate 6 Insertion of new ss 172B and 172C After section 172A— insert— 172B Endorsed podiatrists To the extent necessary to practise podiatry, an endorsed podiatrist is authorised to— (a) obtain a restricted drug mentioned in appendix 2C, part 1, column 1, on a condition mentioned opposite the drug in column 2; or (b) administer, at the place where the endorsed podiatrist practises podiatry, a restricted drug mentioned in appendix 2C, part 1, column 1 on the conditions mentioned opposite the drug in columns 2 and 3; or (c) prescribe a restricted drug mentioned in appendix 2C, part 1, column 1 on the conditions mentioned opposite the drug in columns 2 and 4; or Page 4 2014 SL No. 81
Health Legislation Amendment Regulation (No. 2) 2014 Part 2 Amendment of Health (Drugs and Poisons) Regulation 1996 [s 7] (d) possess a restricted drug mentioned in paragraph (a) at the place where the endorsed podiatrist practises podiatry. 172C Trainee endorsed podiatrists (1) To the extent necessary for a trainee endorsed podiatrist to complete an approved program of study, the trainee endorsed podiatrist is authorised to administer a restricted drug mentioned in appendix 2C, part 1, column 1 under the personal supervision of a doctor or endorsed podiatrist. (2) However, the trainee endorsed podiatrist is only authorised to administer the restricted drug on the conditions mentioned opposite the drug in columns 2 and 3. 7 Amendment of s 200 (Authorised persons to obtain restricted drugs on purchase order) (1) Section 200(3), ‘doctor, optometrist’— omit, insert— doctor, endorsed podiatrist, optometrist (2) Section 200(3)(b)— insert — (ia) by an endorsed podiatrist—must have ‘Section 172B’ written on it; or (3) Section 200(3)(b)(ia) to (iii)— renumber as section 200(3)(b)(ii) to (iv). 8 Amendment of s 235 (Wholesale and retail sales by manufacturers and wholesalers) Section 235(2)(b)(i), ‘pharmacist’— 2014 SL No. 81 Page 5
Health Legislation Amendment Regulation (No. 2) 2014 Part 2 Amendment of Health (Drugs and Poisons) Regulation 1996 [s 9] omit, insert— endorsed podiatrist, pharmacist 9 Insertion of new ss 260B and 260C After section 260A— insert— 260B Endorsed podiatrists To the extent necessary to practise podiatry, an endorsed podiatrist is authorised to— (a) obtain a poison mentioned in appendix 2C, part 2, column 1, on a condition mentioned opposite the poison in column 2; or (b) administer a poison mentioned in appendix 2C, part 2, column 1 on the conditions mentioned opposite the poison in columns 2 and 3; or (c) prescribe or supply a poison mentioned in appendix 2C, part 2, column 1 on the conditions mentioned opposite the poison in columns 2 and 4. 260C Trainee endorsed podiatrists (1) To the extent necessary for a trainee endorsed podiatrist to complete an approved program of study, the trainee endorsed podiatrist is authorised to administer a poison mentioned in appendix 2C, part 2, column 1 under the personal supervision of a doctor or endorsed podiatrist. (2) However, the trainee endorsed podiatrist is only authorised to administer the poison on the conditions mentioned opposite the poison in columns 2 and 3. Page 6 2014 SL No. 81

Health Legislation Amendment Regulation (No. 2) 2014 Part 2 Amendment of Health (Drugs and Poisons) Regulation 1996 [s 11] 11 Amendment of appendix 8 (Restricted drugs of dependency) Appendix 8, entry for alprazolam— omit . 12 Amendment of appendix 9 (Dictionary) Appendix 9— insert — approved program of study , for a trainee endorsed podiatrist, means an approved program of study for endorsement of registration in podiatry under the Health Practitioner RegulationNational Law. endorsed podiatrist means a podiatrist whose registration is endorsed under the HealthPractitioner Regulation National Law, section 94 as being qualified to administer, obtain, possess, prescribe, sell, supply or use a restricted drug or poison stated in Appendix B of the podiatry guideline. podiatric procedure means a diagnostic or therapeutic procedure relating to the foot, ankle or lower leg. podiatry guideline means the document called ‘Guidelines for endorsement for scheduled medicines’, dated 15 March 2011 and published by the Podiatry Board of Australia. Note — A copy of the document is available on the Podiatry Board of Australia’s website at < trainee endorsed podiatrist means a podiatrist undergoing an approved program of study. 2014 SL No. 81 Page 13
