Health Insurance (Variation of Fees and Medical Services) (No. 19) Regulations

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Health Insurance Act 1973.

Citation

 1.These Regulations may be cited as the Health Insurance (Variation of Fees and Medical Services) (No. 19) Regulations.

Commencement

 2. These Regulations shall come into operation on 1 January 1981.

Amendment of Schedule to Health Insurance (Variation of Fees and Medical Services) (No. 17) Regulations

 3. The Schedule to the Health Insurance (Variation of Fees and Medical Services) (No. 17) Regulations (being that Schedule as amended by the Health Insurance (Variation of Fees and Medical Services) (No. 18) Regulations) is amended as set out in the Schedule to these Regulations.

AMENDMENTS OF THE SCHEDULE TO THE HEALTH INSURANCE (VARIATION (NO. 17) REGULATIONS

AMENDMENT OF THE RULES FOR THE INTERPRETATION OF THE TABLE OF MEDICAL SERVICES

After rule 40 add the following rules:

  • “41.

    Where an item in Part 12 includes the symbol ‘(AD)’, the item shall be taken to relate to the service specified in the item when rendered by an accredited dental practitioner.

  • “42.

    (1) Where an item in Part 12 includes the symbol ‘(AO)’, the item shall be taken to relate to the service specified in the item when rendered by a recognized orthodontist.

  • “(2)

    For the purposes of sub-rule (1) and Division 2 of Part 12, a person shall be taken to be a recognized orthodontist —

    • (a)

      where the relevant law makes provision for the separate registration or licensing of orthodontists — if the person is an accredited dental practitioner who is so separately registered or licensed;

    • (b)

      where the relevant law does not make provision as referred to in paragraph (a) but the authority having the responsibility under that law for the registration or licensing of dental practitioners or dentists recognizes certain practitioners as orthodontists — if the person is an accredited practitioner who is so recognized; or

    • (c)

      where paragraphs (a) and (b) do not apply — if the person is an accredited dental practitioner who practises exclusively as an orthodontist.

  • “(3)

    In sub-rule (2), ‘relevant law’ means a law of the State or Territory in which the service is rendered that provides for the registration or licensing of dental practitioners or dentists.

  • “43.

    Where an item in Part 12 includes the symbol ‘(AOS)’, the item shall be taken to relate to the service specified in the item when rendered by an accredited dental practitioner who is a dental practitioner approved by the Minister for the purposes of the definition of 'professional service' in sub-section 3 (1).”.
