Health Insurance Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Health Insurance Act 1973.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Health Insurance Regulations.

Interpretation

2. Regulation 2 of the Principal Regulations is amended by omitting the definition of “provider number” and substituting the following definition:

“provider number” means the identification number allocated to a practitioner, an approved pathology practitioner or a participating optometrist for the purposes of the Act;”.

3. Regulation 9a of the Principal Regulations is repealed and the following regulation substituted:

Allowances for witnesses at hearings before Medical Services Committee of Inquiry or Optometrical Services Committee of Inquiry

“9a. The allowances for expenses payable under section 100 or 106feof the Act in respect of the attendance of a witness at a hearing before a Medical Services Committee of Inquiry or an Optometrical Services Committee of Inquiry are the allowances ascertained by the Committee in accordance with Schedule 2.”.

Schedule 2

4. Schedule 2 to the Principal Regulations is amended by omitting items 1, 2 and 3 and substituting the following items:

“1. A witness attending, because of his or her professional, scientific or other special skill or knowledge, a hearing before a Committee shall be paid the allowance that the witness would be paid under the scale in the Second Schedule to the Federal Court Rules, as in force from time to time, if called before the Federal Court of Australia.

2. A witness, other than a witness referred to in item 1, attending a hearing before a Committee shall be paid the allowance that the witness would be paid under the scale in the Second Schedule to the Federal Court Rules, as in force from time to time, if called before the Federal Court of Australia.

3. A witness attending a hearing before a Committee who is remunerated in his or her occupation by wages, salary or fees shall, in addition to an allowance payable to the witness under item 1 or 2, be paid an allowance equal to the amount of wages, salary or fees lost because of the attendance.”.
