Health Insurance Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under the Health Insurance Act 1973.

After regulation 2abc of the Health Insurance Regulations the following regulation is inserted:

Ascertaining of income—section 5b of the Act

“2abd. For the purposes of section 5b of the Act, the income of a person who is an applicant for the purposes of that section in respect of the prescribed period referred to in subsection (2) of that section is to be ascertained as follows:

(a) in the case of a person to whom an allowance under section 73 of the Social Security Act 1947 is payable—by regarding the income of the person as being an amount that is equal to one 13th of the amount that, under the Social Security Act 1947,is the amount of taxable income of the person that is currently relevant for the purpose of ascertaining the rate of such allowance so payable to the person or, if the amount so arrived at exceeds the amount of allowable income of the person under subsection 5b (2) of the Act, by regarding the income of the person as being an amount equal to the income of the person within the meaning of section 5b of the Act in the prescribed period;

(b) in any other case—by regarding the income of the person as being an amount equal to the income of the person within the meaning of section 5b of the Act in the prescribed period.”.
