Health Insurance Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Health Insurance Act1973.

1.   Commencement

1.1   These Regulations commence on 1 November 1996.

2.   Amendment

2.1   The Health Insurance Regulations are amended as set out in these Regulations.

3.   Regulation 10 (Diagnostic imaging services which dental practitioners may request)

3.1   Subregulation 10 (1):

Omit the subregulation, substitute:

 “10.(1) For subsection 16B (2) of the Act, a service of each of the following kinds is specified:

• (a)

  if the dental practitioner who requests the service is approved by the Minister under paragraph (b) of the definition of ‘professional service’ in subsection 3 (1) of the Act—a service described in any of items 55028, 55030, 55032, 55050, 55052, 56001 to 56216 (inclusive), 56301 to 56507 (inclusive), 56801 to 57007 (inclusive), 57341, 57703, 57709, 57712, 57715, 58103 to 58115 (inclusive), 58306, 58506, 58521 to 58527 (inclusive), 58906, 58909, 59103, 59703, 59742, 59745, 59924, 60000 to 60009 (inclusive), 60506, 60509, 61109, 61372, 61421, 61425, 61429, 61430, 61433, 61434, 61446, 61449, 61450, 61453, 61454, 61457 and 61462;

• (b)

  if the dental practitioner who requests the service is a prosthodontist—a service described in any of items 55050, 55052, 56013, 56016, 56019, 56022, 56028, 61421, 61425, 61429, 61430, 61433, 61434, 61446, 61449, 61450, 61453, 61454, 61457 and 61462;

• (c)

  in any case—a service described in any of items 57509, 57515, 57521, 57527, 57900 to 57945 (inclusive), 58100, 58300, 58503, 58903, 59733, 59739, 59748, 59751, 60100, 60500 and 60503.”.

4.   Regulation 11 (Diagnostic imaging services which chiropractors, physiotherapists and podiatrists may request)

4.1   Subregulation 11 (1):

Omit “57715, 57718”, substitute “57715”.

4.2   Subregulation 11 (1):

Omit “58118”, substitute “58115”.

4.3   Subregulation 11 (2):

Omit “57503,”.

5.   Regulation 12 (Exemption—pre-existing diagnostic imaging services)

5.1   Omit “57718,”.

5.2   Omit “58118”, substitute “58115”.

6.   Regulation 13 (Particulars to be recorded on accounts, receipts and bulk billing agreement)

6.1   Paragraph 13 (17) (a):

After “by”, insert “a consultant physician or”.

7.   Regulation 19 (Information that must be included in requests for diagnostic imaging services)

7.1   Subregulation 19 (1):

Omit “request by a medical practitioner:”, substitute “request:”.
