1Name of Regulations

 These Regulations are the Health Insurance (Pathology Services Table) Amendment Regulations 2004 (No. 1).

2Commencement

 These Regulations commence on 1 May 2004.

3Amendment of Health Insurance (Pathology Services Table) Regulations 2003

Schedule 1 amends the Health Insurance (Pathology Services Table) Regulations 2003.

Application of items 74990 and 74991

  • (4)

    Despite subrules (1), (2) and (3):

    • (a)

      if the pathology service described in item 74991 is provided to a person, either that item or item 74990, but not both those items, applies to the service; and

    • (b)

      if item 74990 or 74991 applies to a pathology service, the fee specified in that item applies in addition to the fee specified in any other item in this table that applies to the service.

    For item 74991:

practice location, in relation to the provision of a pathology service, means the place of practice in respect of which the practitioner by whom, or on whose behalf, the service is provided, has been allocated a provider number by the Commission.

regional, rural or remote area means an area classified as RRMAs 3-7 under the Rural, Remote and Metropolitan Areas Classification.

Rural, Remote and Metropolitan Areas Classification has the meaning given by subrule 3 (1) of Part 2 of Schedule 1 to the general medical services table.

A pathology service to which an item in this table (other than this item or item 74990) applies if:

  • (a)

    the service is an unreferred service; and

  • (b)

    the service is provided to a person who is under the age of 16 or is a Commonwealth concession card holder; and

  • (c)

    the person is not an admitted patient of a hospital or day-hospital facility; and

  • (d)

    the service is bulk-billed in respect of the fees for:

    • (i)

      this item; and

    • (ii)

      the other item in this table applying to the service; and

  • (e)

    the service is provided at, or from, a practice location in:

    • (i)

      a regional, rural or remote area; or

    • (ii)

      Tasmania
