HEALTH INSURANCE LEVIES ACT 1982—REGULATION

(Relating to monthly levies)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Health Insurance Levies Act 1982, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 1 February 1993.

Amendments

2. The Health Insurance Levies Regulation 1983 is amended:

(a) by omitting clause 3 and by inserting instead the following clause:

Certain contributors not counted

3. For the purposes of section 10A (3) (b) of the Act, the

following are prescribed classes of contributors:

(a)

persons who contribute to an organisation for the purpose of securing entitlement only to benefits other than basic health benefits;

(b)

persons who hold one or more of the following cards issued to them by the Commonwealth:

Concession Card;

• Health Benefits Card;

• Health Care Card;

Pensioner Health Benefits and Transport
Concession Card:

• Pharmaceutical Benefits Concession Card and

Social Security Card;

(c)

persons who are in receipt of a service pension under Part III of the Veteran’s Entitlements Act 1986 of the Commonwealth.

(b) by omitting clause 4 and Schedule 1.

EXPLANATORY NOTE

The Health Insurance Levies Act 1982 was amended by the State Revenue Legislation (Further Amendment) Act 1992 to vary the method of calculating the monthly levy on providers of health benefits. Instead of being calculated on the

basis of the amount of conhibutions paid, the amount of the levy will be calculated

on the basis of the number of single or family contributors covered by the health

insurance fund at the beginning of the relevant month. The Act was also amended to dispense with the requirement for a form of return to be prescribed. Instead, the form will be one approved by the Chief Commissioner for Health Insurance Levies.

The object of this Regulation is to amend the Health Insurance Levies Regulation 1982:

• to reflect the change in the method of calculating the monthly levy by omitting provisions dealing with exemptions of certain classes of contributions and by providing instead for exemptions relating to certain classes of contributors; and

• to repeal the prescribed form of monthly return.

The Regulation commences on 1 February 1993, the date of commencement of

the relevant amendments to the Health Insurance Levies Act 1982.

This Regulation is made under the Health Insurance Levies Act 1982, as

amended by the State Revenue Legislation (Further Amendment) Act 1992,

including sections 4, 10A and 11.
