1  Name

This instrument is the Health Insurance Legislation Amendment (Section 3C General Medical Services – Usual Medical Practitioner Exemption) Determination 2021.

2  Commencement

(1)       Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under subsection 3C(1) of the Health Insurance Act 1973.

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1— Amendments

Health Insurance (Section 3C General Medical Services - COVID-19 Telehealth and Telephone Attendances) Determination 2020

1.Subsections 8(10)

Repeal the subsection, substitute:

(10)      Subsection 8(8) does not apply an item listed in Subgroup 3, 10, 15, 16, 19, 20, 21, 25, 26, 27, 28, 29, 39, 40 or 41 of Group A40.

2.Section 5(1) (definition of patient’s usual medical practitioner)

Repeal the definition.

3.Subsections 8(4) and 8(5)

Repeal the subsections.
