1  Name

This instrument is the Health Insurance Legislation Amendment (Section 3C General Medical Services – Drought Affected Areas) Determination 2020.

2  Commencement

(1)       Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subsection 3C(1) of the Health Insurance Act 1973.

4  Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1— Amendments

Health Insurance (Section 3C General Medical Services – General Practitioner Telehealth Services) Determination 2018

1 Subsection 4(1) (definition of drought affected eligible area)

Repeal the definition.

2 Section 6 (below the heading)

Repeal the section, substitute:

(1)        Items 2729 and 2731 do not apply if the patient or the general practitioner travels to a place to satisfy the requirement in paragraph (d) of the item.

(2)        Items 2121, 2150 and 2196 do not apply if the service is performed on an admitted patient of a hospital.

3 Schedule 1 (table items 2121, 2150 and 2196)

Repeal the items, substitute:

2121	Professional attendance by video conference by a general practitioner, lasting less than 20 minutes, for providing mental health services to a patient with mental health issues, if the patient is affected by bushfire	45.55
2150	Professional attendance by video conference by a general practitioner, lasting at least 20 minutes, for providing mental health services to a patient with mental health issues, if the patient is affected by bushfire	88.25
2196	Professional attendance by video conference by a general practitioner, lasting at least 40 minutes, for providing mental health services to a patient with mental health issues, if the patient is affected by bushfire	129.95

Schedule 2— Amendments

Health Insurance (Section 3C General Medical Services – Other Medical Practitioner) Determination 2018

1 Subsection 4(1) (definition of drought affected eligible area)

Repeal the definition.

2 Schedule 1 (subclause 1.12.4(2))

Repeal the subclause, substitute:

(2)   Items 894, 896 and 898 do not apply if the service is performed on an admitted patient of a hospital.

3 Schedule 1 (table items 894, 896 and 898)

Repeal the items, substitute:

894	Professional attendance by video conference by a medical practitioner, lasting more than 5 minutes but not more than 25 minutes, for providing mental health services to a patient with mental health issues, if the patient is affected by bushfire	36.45
896	Professional attendance by video conference by a medical practitioner, lasting more than 25 minutes but not more than 45 minutes, for providing mental health services to a patient with mental health issues, if the patient is affected by bushfire	70.60
898	Professional attendance by video conference by a medical practitioner, lasting more than 45 minutes, for providing mental health services to a patient with mental health issues if the patient is affected by bushfire	103.95
