I, TONY KINGDON, First Assistant Secretary, Medical Benefits Division, a delegate of the Minister for Health and Ageing, make this Determination under subsection 3C (1) of the Health Insurance Act 1973.

  1. Name of Determination

This Determination is the Health Insurance (Follow up service — Indigenous persons) Determination 2008.

  1. Commencement

This Determination commences on 1 November 2008.

  1. Interpretation

In this Determination:

Act means the Health Insurance Act 1973.

practice nurse means a registered or enrolled nurse who is employed by, or whose services are otherwise retained by, a general practice or by a health service to which a direction under subsection 19 (2) of the Act applies.

registered Aboriginal health worker means a person in the Northern Territory who:

(a)    is registered as an Aboriginal health worker under the Health Practitioners Act (NT); and

(b)    is employed or retained by a general practice or by a health service to which a direction under subsection 19 (2) of the Act applies.

Note   The following terms are defined in subsection 3 (1) of the Act:

·      general medical services table

·      medical practitioner.

  1. Treatment of service

(1) The service mentioned in Schedule 1 is to be treated, for all provisions of the Act, regulations made under the Act, the National Health Act 1953 and regulations made under the National Health Act 1953, as if:

(a)    it were both a professional service and a medical service; and

(b)    there were an item in the general medical services table that:

(i)    related to the service; and

(ii)    specified for the service a fee in relation to each State, being the fee mentioned in the item in Schedule 1 relating to the service.

Note   An internal Territory is taken to form part of the State of New South Wales  — see subsection 3C (7) of the Act.

(2) Schedule 6 of the Health Insurance Regulations 1975 has effect as if the item in Schedule 1 were also specified in that Schedule.


Schedule 1        Follow up service — Indigenous persons

Follow up service provided by a practice nurse or registered Aboriginal health worker for an Indigenous person who has received a health check, if:

   (a)  the service is provided on behalf of and under the supervision of a medical practitioner (including a general practitioner but not including a specialist or consultant physician); and

   (b)  the person is not an admitted patient of a hospital; and

   (c)  the service is consistent with the needs identified through the health check;

to a maximum of 5 services per patient in a calendar year
