Name of Determination
This Determination is the Health Insurance (Eligible Pathology Laboratories) Determination 2015.
Commencement
This Determination commences on the day after registration.
3. Authority
This Determination is made under the Health Insurance Act 1973.
4. Interpretation
In this Determination:
Act means the Health Insurance Act 1973.
Category GX (General) means the category of that name set out in section 17 of in the Health Insurance (Accredited Pathology Laboratories – Approval) Principles 2002, as in force from time to time.
Category GY (General) meas the category of that name set out in section 17 of the Health Insurance (Accredited Pathology Laboratories – Approval) Principles 2002, as in force from time to time.
Category S (Specialised) meas the category of that name set out in section 17 of the Health Insurance (Accredited Pathology Laboratories – Approval) Principles 2002, as in force from time to time.
recognized hospital has the same meaning as it did in the Act immediately before the commencement of item 31 of the Health Legislation Amendment (Medical Practitioners’ Qualifications and Other Measures) Act 2001.
Rural/Remote Areas Classification means the document of that name published in January 1994 by the Department of Human Services and Health.
Note 1Unless the contrary intention appears, expressions used in this determination have the same meanings as in the Act—see section 13 of the Legislative Instruments Act 2003. The following terms are defined in subsection 3(1) of the Act:
· accredited pathology laboratory
· approved pathology authority
Note 2 Item 31 to the Health Legislation Amendment (Medical Practitioners’ Qualifications and Other Measures) Act 2001 commenced on 1 December 2001.
5. Categories of eligible pathology laboratories
For the purpose of the definition of eligible pathology laboratory in subsection 23DA(1) of the Act, the following categories are prescribed:
(a) accredited pathology laboratories allocated Category GX (General) in the approval given under section 23DN of the Act relating to the laboratory;
(b) accredited pathology laboratories allocated Category GY (General) in the approval given under section 23DN of the Act relating to the laboratory;
(c) accredited pathology laboratories allocated Category S (Specialised) in the approval given under section 23DN of the Act relating to the laboratory;
(d) accredited pathology laboratories, in respect of which the approved pathology authority that is the sole proprietor has entered into an arrangement with another approved pathology authority for the use of an accredited pathology laboratory allocated Category GX (General) or Category GY (General) in the approval given under section 23DN relating to the laboratory, if immediately before the commencement of item 31 of the Health Legislation Amendment (Medical Practitioners’ Qualifications and Other Measures) Act 2001, the approved pathlogy authority operated a collection centre that:
(A) was not located on the hospital premises of a recognized hospital; and
(B) was in an area that, in the Rural/Remote Areas Classification, is:
(A) a Rural Major statistical local area; or
(B) a Rural Other statistical area; or
(C) a Remote Major statistical local area; or
(D) a Remote Other statistical local area.
