1Name of Regulations

 These Regulations are the Health Insurance (Diagnostic Imaging Services Table) Amendment Regulations 2001 (No. 4).

2Commencement

 These Regulations commence on 1 July 2001.

3Amendment of Health Insurance (Diagnostic Imaging Services Table) Regulations 2000

Schedule 1 amends the Health Insurance (Diagnostic Imaging Services Table) Regulations 2000.

31MRI and MRA services — eligible equipment

• (1)

  For rule 27, equipment is eligible equipment if the requirements of this rule are met in relation to the equipment.

• (2)

  The equipment must:

  • (a)

    be:

    • (i)

      equipment described in columns 3 and 4 of an item in Schedule 2 by reference to manufacturer, scanner model, magnet strength and magnet serial number; or

    • (ii)

      equipment to which subparagraph (i) applies (the original equipment), any or all of which, after 1 July 2001, is permanently replaced by equipment of the same or greater magnet strength as the original equipment; or

    • (iii)

      equipment that, after 1 July 2001, is temporary replacement equipment for equipment to which subparagraph (i) or (ii) applies; and

  • (b)

    be located in:

    • (i)

      a medical practice, or the radiology department of a hospital, specified in column 2 of the relevant item in Schedule 2 (the original place); or

    • (ii)

      after 1 July 2001, another medical practice, or radiology department of a hospital, that offers a comprehensive range of diagnostic imaging procedures, and that has the same postcode as the original place.

• (3)

  If, after 1 July 2001, all or a part of the equipment is permanently replaced, the Commission must have been given, before the replacement took place, a written notice:

  • (a)

    giving details of the proposed replacement; and

  • (b)

    if any of the information in Schedule 2 in relation to the equipment has changed because of the replacement — stating the correct information.

• (4)

  If, after 1 July 2001, the equipment is replaced by temporary replacement equipment, the Commission must have been given, before the date when the temporary replacement equipment is to begin operating, a written notice stating:

  • (a)

    the name and address of the place where the temporary replacement equipment is to be installed; and

  • (b)

    the manufacturer, scanner model, magnet strength and magnet serial number of the temporary replacement equipment; and

  • (c)

    the date when the temporary replacement equipment is to begin operating; and

  • (d)

    the date when the temporary replacement equipment is to cease operating.

• (5)

  If, after 1 July 2001, the equipment is moved to another place mentioned in subparagraph (2) (b) (ii), the Commission must have been given, before the equipment is moved, a written notice stating:

  • (a)

    the name and address of the place to which the equipment is to be moved; and

  • (b)

    the date when the equipment is to be moved.

• (6)

  For this rule:

comprehensive, in relation to a range of diagnostic imaging procedures, means that the range includes x‑ray, ultrasound and computed tomography (CT) procedures.

medical practice means a medical practice conducted by:

• (a)

  a sole practitioner; or

• (b)

  a group of practitioners within the meaning of subsection 16A (9) or (10) of the Act; or

• (c)

  a medical entrepreneur.

temporary replacement equipment, for equipment to which subparagraph (2) (a) (i) or (ii) applies (the permanent equipment), means equipment that:

• (a)

  is able to be used to perform the same kind of diagnostic imaging procedures as the permanent equipment; and

• (b)

  is used for no longer than 2 months, in a medical practice, or radiology department of a hospital, that offers a comprehensive range of diagnostic imaging procedures, and that has the same postcode as the place where the permanent equipment was being used, while the permanent equipment is being serviced or repaired.
