Health Insurance Commission Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Health Insurance Commission Act 1973.

Commencement

1. (1) Regulation 3 shall be taken to have commenced on 24 April 1985.

(2) Regulations 2 and 4 shall be taken to have commenced on 22 May 1986.

Interpretation

2. Regulation 2a of the Health Insurance Commission Regulations is amended by inserting after the definition of “registered organization” the following definition:

“ ‘Repatriation Commission’ means the Repatriation Commission continued in existence by section 179 of the Veterans Entitlements Act 1986;”.

Additional functions of the Commission

3. Regulation 4 of the Health Insurance Commission Regulations is amended by inserting in subregulation (2) “and Division 2 of Part IV of the Seamen’s War Pensions and Allowances Regulations” after “Regulations”.

Additional functions of the Commission

4. Regulation 4 of the Health Insurance Commission Regulations is amended:

(a) by omitting subregulation (1);

(b) by omitting from subregulation (2) “Part IV of the Repatriation Regulations and”;

(c) by inserting in subregulation (2) “and Part V of the Veterans Entitlements Act 1986”after “Allowances Regulations”.

Saving

5. (1) In this regulation, “authority of the Commonwealth” has the same meaning as in subregulation 48 (2) of the Acts Interpretation Act 1901.

(2) Nothing in these Regulations shall be taken:

(a) to affect the rights of a person (other than the Commonwealth or an authority of the Commonwealth) existing at the commencement of these Regulations in a manner prejudicial to that person; or

(b) to impose liabilities on any person (other than the Commonwealth or an authority of the Commonwealth) in respect of anything done or omitted to be done before the commencement of these Regulations.
