Health Insurance Commission Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Health Insurance Commission Act 1973.

1. Commencement

1.1 These Regulations are taken to have commenced on 1 May 1993

 

2. Amendment

2.1 The Health Insurance Commission Regulations are amended as set out in these Regulations.

3. New regulation 3h

3.1 After regulation 3g, insert:

Additional functions of the Commission: payments on behalf of Australian Hearing Services

“3H. (1) In this regulation:

‘Authority’ means the authority known as Australian Hearing Services established by section 7 of the Hearing Services Act 1991;

‘benefit provider’ means a person or body with whom the Authority has made an arrangement under paragraph 8 (1) (d) of the Hearing Services Act 1991 for the supply of hearing services.

“(2) For the purposes of subsection 8e (1) of the Act, the following function is prescribed, namely the payment, on behalf of the Authority, of claims by benefit providers for the supply of hearing services.

“(3) For the purposes of the function conferred by subregulation (2), the Commission may release the following information to the Authority with regard to each claim processed by the Commission:

(a) client number;

(b) date of processing;

(c) provider number;

(d) hearing services card expiry date;

(e) hearing loss details for both right and left ears;

(f) whether the provider consulted with an Authority audiologist;

(g) item number;

(h) date of service;

(i) device fitted, whether fitted to the left or right ear, and fitting configuration;

(j) date on which the device was fitted.”.
